Explanation
This ordinance authorizes the Public Service Director to enter into a contract for the Transportation Division with American Pavements for the sealing of city streets. The Transportation Division is responsible for maintaining the City's roadway system through a viable preventive maintenance program. A slurry seal project is needed to prevent premature deterioration of the City's roadways. The contract will consist of placing slurry seal on forty residential roadways. The Transportation Division will perform inspection services at a cost not to exceed $12,130.00. This project was bid in compliance with the City Code and advertised in the City Bulletin. Formal competitive bids were received and tabulated on June 3, 2004 by the Transportation Division as follows:

The Transportation Division recommends a contract award to American Pavements, Incorporated, (Contract Compliance Number 31-1409601; Expiration Date January 29, 2006) as the lowest, best, most responsive, and most responsible bidder.
Fiscal Impact: The Transportation Division budgeted $15.5 million for resurfacing of city streets in the 2004 Capital Improvements Budget. This ordinance authorizes an expenditure of $163,721.48 for the sealing of city streets within the resurfacing budget. Approximately $274,595.92 was spent on slurry seal in 2003.
Emergency action is requested to allow this project to be completed this construction season.

To authorize the Public Service Director to enter into a contract with American Pavements, Incorporated, for the Slurry Seal - 2004 project for the Transportation Division; to authorize the expenditure of $163,721.48 from the 1995, 1999 Voted Streets and Highways Fund, and to declare an emergency. WHEREAS, the Transportation Division is responsible for maintaining the City's roadways; and
WHEREAS, slurry seal is needed to prevent early deterioration of the City's roadway system; and
WHEREAS, formal competitive bids were opened and tabulated on June 3, 2004 by the Transportation Division for the Slurry Seal - 2004 project and a satisfactory low bid was received; and
WHEREAS, the Transportation Division recommends a contract award to American Pavements, Incorporated as the lowest, best, most responsive and most responsible bid, and
WHEREAS, funds are budgeted and available for this expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be awarded immediately so that the work may proceed without delay and be completed this construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and hereby is authorized to enter into a contract with American Pavements, Incorporated, 7475 Montgomery Drive, Plain City, Ohio 43064 for the Slurry Seal - 2004 project in accordance with the applicable specifications and plans on file in the office of the Transportation Administrator, which are hereby approved, and to provide for construction inspection services.
SECTION 2. That for the purpose of paying the cost of the contract and inspections the sum of $163,721.48, or so much thereof as may be needed, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385 and Project 530282.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
