Explanation

 

BACKGROUND: Need: This legislation authorizes a modification to the contract for professional engineering services with Camp Dresser & McKee for the Bliss Run Trunk Sewer Improvements Project. 

 

This modification is requested to allow payment for the development of construction plans and specifications and to add curb ramp details and a striping plan to these documents for Phase 3 of the Bliss Run project. 

 

Contract Compliance No.: 04-2473650

 

Emergency Designation: Emergency designation is requested for this ordinance so that the construction of Phase 3 may proceed as scheduled to alleviate flooding in this area.

 

FISCAL IMPACT:

 

Budgeted Amount.  There are funds and sufficient spending authority available for this expenditure pending passage of a transfer/CIB amendment ordinance.

 

Contract Modification Information Pursuant to Section 329.13C.C.C.:

 

Amount of Additional Funds - This Modification: $721,942.00.

 

Why the Need for Additional Work Could Not Be Foreseen: This project is a multi-phase project.  One phase must be completed before the next phase may proceed.   Phase II of this project is being prepared for construction and it is now time to begin the professional engineering design services for Phase III.

 

Why Other Procurement Processes Would Not Be in the City's Best Interest: This additional work is a direct, logical extension of the work included in the contract, and it is not deemed either feasible or reasonable to suspend work with the entity currently under contract and undertake continuation of the work under a new procurement.

 

How the Cost of the Modification Was Determined: Price quotes for the additional design services under this modification were requested by the Division, prepared by the design engineer, and were subsequently reviewed and revised by Stormwater staff and deemed to be appropriate.

 

Contract Amount: The new contract amount including this modification is $3,001,958.00.  The original contract amount is $73,849.00;  Modification No. 1, $756,507.00; Modification No. 2, $383,597.00; Modification No. 3, $558,263.00; Modification No. 4, $489,325.00; Modification No. 5, $18,475.00; and Modification No. 6, $721,942.00.

Body

 

WHEREAS, it is required in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, to maintain, upgrade and expand its storm sewer collection system; and

 

WHEREAS, Contract No. XC815322 was authorized by Ordinance No. 2679-93, passed December 13, 1993; executed December 29, 1993; and approved by the City Attorney on January 18, 1994; and

 

WHEREAS, Modification No. 1 was authorized by Ordinance No. 2896-95, passed December 18, 1995; executed January 26, 1996; and approved by the City Attorney on February 16, 1996; and

 

WHEREAS, Modification No. 2 was authorized by Ordinance No. 1109-98, passed April 27, 1998; executed May 13, 1998; and approved by the City Attorney on May 21, 1998; and

 

WHEREAS, Modification No. 3 was authorized by Ordinance No. 1657-01, passed October 22, 2001; executed November 28, 2001; and approved by the City Attorney on December 3, 2001; and

 

WHEREAS, Modification No. 4 was authorized by Ordinance No. 430-02, passed March 18, 2002; executed March 22, 2002; and approved by the City Attorney on March 25, 2002; and

 

WHEREAS, Modification No. 5 was authorized by Ordinance No. 868-02, passed June 3, 2002; executed June 5, 2002; and approved by the City Attorney on June 14, 2002; and

 

WHEREAS, it is necessary to modify Contract No. XC815322 to authorize the additional funds required to allow payment to Camp Dresser & McKee for additional professional engineering services associated with the Bliss Run Trunk Sewer Improvements Project; now, therefore,

 

WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to modify the contract for professional engineering design and technical project services for the Bliss Run Trunk Sewer Improvements Project, for the preservation of the public health, peace, property and safety; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. XC815322 with Camp Dresser & McKee, 8800 Lyra Drive, Columbus, Ohio 43240 for professional engineering services in connection with the Bliss Run Trunk Sewer Improvements Project, in order to provide for payment of additional services in accordance with the terms and conditions as shown on the contract on file in the office of the Division of Sewerage and Drainage.

 

Section 2. That for the purpose of paying the cost of the professional engineering services contract modification, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-15; Fund 685; Project 610923; Object Level Three 6682; OCA Code 685923; Amount $721,942.00.

 

Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
