Explanation
 
BACKGROUND:  Improvements to incorporate a chlorine gas scrubber system at the Dublin Road Water Plant will provide compliance with all applicable codes, as well as increase safety.  The chlorine scrubber installation is a temporary measure as the Dublin Road Water Plant is currently being redesigned to utilize a different disinfection chemical in lieu of gaseous chlorine.  It is anticipated that the new disinfection facility will be bid for construction in 2006, and on-line in 2007. This contract provides for the installation of the temporary scrubber and all associated miscellaneous electrical and mechanical modifications to complete the installation.
 
The procurement of this contract was conducted in accordance with Section 329.09.
 
Competitive bids were received and opened at the office of the Director of Public Utilities on March 23, 2005.  Of the five (5) bids received, the lowest responsive and responsible and best bidder was the Righter Company, Inc.  The bid of Downing Construction Company was non-responsive due to failure to complete the requirements of TIER I - MANDATORY FACTOR M-5 Construction Trades Licenses / Certificates Required.  The bid of Ameritcon, Inc. was non-responsive due to failure to provide a proposal bond amount of not less than 10% of their bid in accordance with CMSC 102.08.  Bidders that are determined non-responsive to these mandatory factors shall not be considered for further evaluation under Tier II - Creditable Factors.

EMERGENCY:  Emergency legislation is being requested to install this temporary chlorine gas scrubber system as soon as possible for the increased safety of the plant.
 
FISCAL IMPACT:  The Dublin Road Water Plant Chlorine Storage Facility, project 690379 was included in the 2003 CIB and was bid but subsequently not awarded.  The money is now available as unencumbered cash so therefore this project is being funded from current monies.

Body
 
WHEREAS, the Director of Public Utilities did receive and open bids on March 23, 2005 for the Dublin Road Water Plant Disinfection and Miscellaneous Improvements Temporary Scrubber for the Division of Water, Department of Public Utilities, and
 
WHEREAS, a satisfactory low bid has been received, and
 
WHEREAS, an emergency exists in the usual daily operations of the Division of Water, Department of Public Utilities in that it is immediately necessary to authorize the Director of Public Utilities to enter into a Contract with the Righter Company, for the Dublin Road Water Plant Disinfection and Miscellaneous Improvements Temporary Scrubber to install this temporary chlorine gas scrubber system as soon as possible for the increased safety of the plant, for the Division of Water, and for the preservation of public health, peace, property safety and welfare, now, therefore;
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1. That the Director of Public Utilities be and is hereby authorized to enter into a Contract with the Righter Company, in the amount of $322,350.00 for the Dublin Road Water Plant Disinfection and Miscellaneous Improvements Temporary Scrubber for the Division of Water, Department of Public Utilities, Contract No. 966, Part 3 on the basis of the lowest responsive and responsible and best bid received on March 23, 2005.
 
Section 2. That for the purpose of paying the cost thereof, the expenditure of $322,350.00 is hereby authorized from Waterworks Enlargement Voted 1991 Bonds Fund No. 606, Department of Public Utilities, Division of Water, Dept./Division No. 60-09, Object Level Three 6623, Project No. 690379, OCA Code 606379.
 
Section 3. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project; that the project has been completed and the monies are no longer required for said project except that no transfer shall be so made from a project account funded by monies from more than one source.
 
Section 4.  That Section  1, Public Utilities/Water 60-09 or Ordinance 1059-2004 is hereby amended as follows:

Section 5.  That for reasons stated in the preamble, hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after approval if the Mayor neither approves nor vetoes the same.
