Explanation
 
M/I SCHOTTENSTEIN HOMES, INC., an Ohio corporation, by STEPHEN M. CAPLINGER, Vice President Land Operations has submitted the plat titled UPPER ALBANY SECTION 3 to the City Engineer's Office for review and approval.  This plat has been reviewed and approved by the City Engineer.  The following legislation allows the City to accept said plat for property located north of Central College Road and west of New Albany Road West.

To accept the plat titled UPPER ALBANY SECTION 3, from M/I SCHOTTENSTEIN HOMES, INC., an Ohio corporation, by STEPHEN M. CAPLINGER, Vice President Land Operations and to declare an emergency.
 
Body
 
WHEREAS, the plat titled UPPER ALBANY SECTION 3 (hereinafter "plat"), has been submitted to the City Engineer's Office for approval and acceptance; and
 
WHEREAS, M/I SCHOTTENSTEIN HOMES, INC., an Ohio corporation, by STEPHEN M. CAPLINGER, Vice President Land Operations, owner of the platted land, desires to dedicate to the public use all or such parts of the Court, Drives, Street shown on said plat and not heretofore so dedicated; and
 
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; now, therefore
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary that the Upper Albany Section 3 (1952 - 2003) final plat approval be amended to emergency because construction of the public improvement is ahead of schedule for the immediate preservation of the public peace, property, health and safety; now therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the plat titled UPPER ALBANY SECTION 3 on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.
 
Section 2.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
