Explanation

 

1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into an agreement with Fuller, Mossbarger, Scott and May Engineers, Inc. for professional engineering services for the Safford/Union Area Stormwater System Improvements; to authorize the City Auditor to transfer $57,317.96 within the Storm Sewer Bond Fund; and to amend the 2007 Capital Improvements Budget.

 

This is a joint project between the Division of Sewerage and Drainage and the Division of Power and Water that will mitigate poor drainage and replace water lines along Union, Springmont, Safford and Homewood Avenues between Highland and Whitethorne Avenues, and mitigate poor drainage along Clarendon Avenue between Sullivant Avenue and Mound Street on the Westside of Columbus.  The total cost of the agreement is $230,052.43; $197,317.96 from the Storm Sewer Bond Fund and $32,734.47 from the Waterworks Enlargement Voted 1991 Bonds Fund.

 

2.  BID INFORMATION:  The selection of the firm providing the professional engineering services has been performed in accordance with the procedures set forth in Columbus City Code, Section 329.11, "Awarding professional service contracts through requests for statements of qualifications." Statement of Qualifications were received on October 27, 2006.  Three consultants were selected to submit technical proposals for this project.  Columbus Engineering Consultants, Inc., Fuller, Mossbarger, Scott and May Engineers, Inc. and Jones-Stuckey Ltd. submitted a proposal on April 13, 2007.  More detailed information is contained within the Legislation Attachment.

 

3.  CONTRACT COMPLIANCE INFORMATION:

4.  FISCAL IMPACT:  The Division of Sewerage and Drainage is requesting an amendment to the 2007 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure.  In addition this legislation includes a transfer of funds within the Storm Sewer Bonds Fund.  There is sufficient cash and authority within the Waterworks Enlargement Voted 1991 Bonds Fund for the Division of Power and Water's portion.

To authorize the Director of Public Utilities to enter into contract with Fuller, Mossbarger, Scott and May Engineers, Inc. to provide professional engineering services for the Safford/Union Area Stormwater System Improvements; to authorize the transfer of $57,317.96 and expenditure of $197,317.96 within the Storm Sewer Bond Fund; to amend the 2007 Capital Improvements Budget, for the Division of Sewerage and Drainage, and to authorize the expenditure of $32,734.47 from the Waterworks Enlargement Voted 1991 Bonds Fund for the Division of Power and Water and to declare an emergency.  ($230,052.43)

 

Body

 

WHEREAS, significant flooding and other stormwater problems have been identified through customer complaints for the area covered by this project; and

 

WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Storm Sewer Bond Fund; and

 

WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and

 

WHEREAS, replacement of water lines along Union, Springmont, Safford and Homewood Avenues between Highland and Whitethorne Avenues have been identified; and

 

WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into an agreement for professional engineering services to mitigate the significant flooding and other stormwater problems and replace necessary water lines; and  now therefore,

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Utilities in that it is immediately necessary to pass t his ordinance as an emergency measure because of the need to complete the design and construction projects on time; for the preservation of the public health, peace, property,safety, and welfare; now therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the City Auditor is hereby authorized to transfer $57,317.96 within the Storm Sewer Bonds Fund, Fund 685, Division of Sewerage and Drainage, Division 60-15, as follows:

SECTION 2.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 3.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 5. That the Director of Public Utilities be, and hereby is, authorized to execute an agreement with Fuller, Mossbarger, Scott and May Engineers, Inc.; 6600 Busch Boulevard, Suite 100, Columbus, Ohio 43229, for the Department of Public Utilities, for professional engineering services in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage and Division of Power and Water.

 

SECTION 6. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities, the Administrator of the Division of Sewerage and Drainage and the Administrator of the Division of Power and Water.

 

SECTION 7.  That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, is hereby authorized as follows:  Division 60-15| Fund 685| Project 610761| Object Level Three 6682| OCA Code 685761| Amount $197,317.96.

 

SECTION 8.  That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, is hereby authorized as follows:  Division 60-09| Fund 606| Project 690236| Object Level Three 6629| OCA Code 642900| Amount $32,734.47.

 

SECTION 9.  That the 2007 Capital Improvements Budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of the engineering agreement stated in Section 5 herein.

SECTION 10. That this ordinance shall take effect and be in force from and after the earliest period allowed by lawThat for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
