Explanation
BACKGROUND:
Need: The Division of Police needs to purchase rifles and accessories for the S.W.A.T. section. These rifles will replace worn out rifles.
Bid Information: The Purchasing office advertised and solicited competitive bids in accordance with Section 329.06 (Solicitation No. SA001220) for the purchase of rifles and accessories. Thirty-nine (MAJ:38, MBE:0, FBE:0) bids were solicited; eight (MAJ:8) bids recieved. While there were some line items that were lower, the bid was considered as a package for assembly purposes and to insure delivery of all parts at the same time for training purposes. With the 1% local vendor credit taken into consideration, the Division of Police recommends that the award be made to the lowest responsive, responsible and best bidder, Vance Outdoors, Inc. This company is not debarred according to the Federal Excluded Parties Listing or prohibited from being awarded a contract according to the Auditor of State Unresolved Findsings for Recovery Certified Search.:

Emergency Designation: Since all training on this new rifle system will be done on the outdoor range, emergency legislation is requested so rifles can be delivered in a timely manner before the weather conditions get colder.
FISCAL IMPACT:
Since this purchase will be made with Drug Seizure Funds, there will be no effect on the financial status of the General Fund.

To authorize and direct the Finance Director to enter into a contract for the purchase of rifles and accessories with Vance Outdoors, Inc., for the Division of Police, to authorize the expenditure of $50,654.70 from the Law Enforcement Drug Seizure Funds; and to declare an emergency ($50,654.70).
Body
WHEREAS, the Purchasing office advertised and solicited formal bids on July 29, 2004 and selected the lowest responsive, responsible, and best bidder; and
WHEREAS, in order to allow time for training of the new rifle system, this is being submitted for approval as an emergency measure; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Police in that it is immediately necessary to enter into a contract for an option to purchase rifles and accessories in order to conduct necessary training prior to inclement winter weather, thereby preserving the public health, peace, property, safety, and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Finance Director be and is hereby authorized and directed to enter into contract for the purchase of rifles and accessories for the Division of Police, Department of Public Safety, based on Vance Outdoors, Inc.'s bid being the lowest and best bid meeting all specifications in accordance with Solicitation No. SA001220.
Section 2. That the expenditure of $50,654.70 or so much thereof as may be needed, be and the same is hereby authorized as follows:

Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
