Explanation
 
Background:  This legislation authorizes the City to enter into a contract in an amount up to $1,467,428.26 for the Oakland Park Avenue Improvements project and to pay construction inspection costs up to $176,091.00.  This improvement details construction on Oakland Park Ave. from Beulah Rd. to Gerbert St. and from Bremen St. to Cleveland Ave. (see the attached map).  The work involves replacing sidewalks, curbs, drive approaches and other associated work.  The estimated Notice to Proceed date is April 2, 2007.  This project is to be constructed by July 31, 2007.  The project was let by the Transportation Division and was advertised in the City Bulletin, Dodge Reports, and by the Builders Exchange.  Seven bids were received (six majority, one minority) and tabulated on December 15, 2006 as follows:

Award is to be made to Columbus Asphalt Paving, Inc., CC# 31-0857095 (expiration 5/23/2008), as the lowest, best, most responsive and most responsible bidder.
 
Fiscal Impact:  Funding for this project is budgeted within the Transportation Division as part of the Urban Infrastructure Program and is available within the 1995, 1999 and 2004 Voted Streets and Highways Fund for this work.

Body
 
WHEREAS, bids were received on December 14, 2006, and tabulated on December 15, 2006, for the Oakland Park Avenue Improvements project; and
 
WHEREAS,  a satisfactory bid has been received; and
 
WHEREAS, it is necessary to provide for construction inspection costs; and  how, therefore:
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service and Transportation in that it is immediately necessary to pass this ordinance as an emergency measure because of the need to have the construction started as soon as possible to meet the projected completion date of  July 31, 2007; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Public Service Director be and is hereby authorized to enter into a contract with Columbus Asphalt Paving, Inc., 1196 Technology Drive, Gahanna, Ohio 43230, for the construction of the Oakland Park Avenue Improvements project in the amount of $1,467,428.26, for the Transportation Division in accordance with the specifications and plans on file in the office of the Director of Public Service, which are hereby approved; to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $176,091.00.
 
SECTION 2.  That for the purpose of paying the cost of the contract and inspection, the sum of $1,643,519.26 or so much thereof as may be needed, is hereby authorized to be expended from the 1995, 1999 and 2004 Voted Streets and Highways Fund, no. 704, for the Transportation Division, Dept./Div 59-09, OCA Code 644385, Object Level Three 6631 and project 440005.
 
SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
