APPLICANT:  Derek M. Cranstoun; 3050 Peters Street; Brice, OH 43109.

                     

PROPOSED USE:  Single-family dwellings.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on December 13, 2007.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The proposed RRR, Restricted Rural Residential District development on lots with minimum lot areas of  10,000 square feet is compatible with the zoning and development patterns of the area.

To rezone 3050 PETERS STREET (43109), being 6.9± acres located on the east side of Peters Street, 50± feet south of Compton Street (530-166426). From: R, Rural District, To: RRR, Restricted Rural Residential District.  (Rezoning # Z06-077)

WHEREAS, application #Z06-077 is on file with the Building Services Division of the Department of Development requesting rezoning of 6.9± acres from R, Rural District, to the RRR, Restricted Rural Residential District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the proposed RRR, Restricted Rural Residential District development on lots with minimum lot areas of  10,000 square feet is compatible with the zoning and development patterns of the area, therefore:   

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

3050 PETERS STREET (43109), being 6.9± acres located on the east side of Peters Street, 50± feet south of Compton Street (530-166426), and being more particularly described as follows:

 

LEGAL DESCRIPTION OF PROPERTY:

 

Approximated Boundary as follows:

 

Beginning at the southeast corner of the east-west division line of Brice Village, being the southwest corner of said Cranstoun property thence S 8625' E, a distance of 1336.5 feet to a point in the southerly right-of-way of the New York Central Railroad (now Conrail), thence northerly along said right-of-way, being the easterly limits of said Cranstoun property, following a curve to the right having a radius of 7294.8 feet, a delta of 8 22' 29", and a chord bearing and distance of N 65 27' 40" W, 1065.3 feet (arc length of 1066.4 feet), to a point, being the northeast corner of said Cranstoun property and the southeast corner of tract of land conveyed to Arvena C. Riffle (PID 530-166438) which was excepted from the original deed of reference then, N 86 25' W, a distance of 340 feet to a point in the east line of said Brice Village, thence along said dividing line, S 3 50' W, a distance of 381.0 feet to the true point of beginning, containing 6.882 acres, more or less.

 

To Rezone From: R, Rural District,

 

To: RRR, Restricted Rural Residential District

 

Section 2.  That a Height District of thirty-five (35) feet is hereby established on the RRR, Restricted Rural Residential District on this property.

 

Section 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.

 

Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
