Explanation
Background: The City of Columbus is engaged in the Broughton Avenue Extension project. The purpose of this project is to extend Broughton Avenue from its existing terminus east of Outerbelt Street easterly to McCormick Boulevard. Completion of this project will provide vehicular access and will enhance development opportunities for adjacent properties. New pavement, sidewalks, drainage structures and lighting will be installed as a part of this project. Preliminary acquisition cost estimates indicate $50,000.00 will be required for acquisition-related activities including acquisition of fee simple title and lesser interests in and to property needed for this project. This legislation authorizes the City Attorney to expend $50,000.00 or so much thereof as may be necessary for this project.
Fiscal Impact: The Transportation Division budgeted $2.14 million in the 2004 Capital Improvements Budget (CIB) for Roadway Improvements. Nearly $1.78 million has been either expended or encumbered from the 2004 CIB for Roadway Improvements. This ordinance authorizes $50,000 for acquisition-related expenses for the Broughton Avenue Extension project.
Emergency action is requested to allow right-of-way acquisition-related activities to be initiated by the City Attorney's Office, Real Estate Division, as soon as possible so that construction of this improvement project can begin without delay.

To authorize the City Attorney to expend $50,000.00 for acquisition-related activities including the acquisition of fee simple title and lesser interests in and to property needed for the Broughton Avenue Extension project for the Transportation Division; to authorize the expenditure of $50,000.00 from the 1995, 1999 Voted Streets and Highways Fund, and to declare an emergency. WHEREAS, the City of Columbus is engaged in the Broughton Avenue Extension project; and
WHEREAS, the purpose of this project is to extend Broughton Avenue from its existing terminus east of Outerbelt Street easterly to McCormick Boulevard; and
WHEREAS, included in this project are the installation of new pavement, sidewalks, drainage structures and lighting; and
WHEREAS, the initial acquisition funding estimate is $50,000.00; and
WHEREAS, funds are available within the 1995, 1999 Voted Streets and Highways Fund to pay for said acquisition-related costs; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the funds necessary to hire professional services and begin acquisition of necessary right-of-way for the Broughton Avenue Extension project so that construction of this project can begin without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Attorney be and hereby is authorized to begin the acquisition-related activities necessary to acquire fee simple title and lesser interests in and to those parcels needed for the Broughton Avenue Extension project for the Transportation Division and to expend those funds required to pay said related acquisition costs.
SECTION 2. That for the purpose of paying said costs the City Attorney's Office, Real Estate Division be and hereby is authorized to expend $50,000.00, or so much thereof as may be necessary from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09; Object Level One Code 06, Object Level Three Code 6601, OCA Code 644385 and Project 530161.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
