Explanation
This ordinance will authorize the Director of the Department of Technology to enter into contract with Oracle Corporation, for software maintenance support and upgrades associated with software that supports business management applications utilized citywide; such as 311, WASIMS, Performance Series, Income Tax, GIS and various other applications.  The software is server based and has given the city the capability to web enable applications for citizens' use and ensure compliance with licensing agreements.  However, the original contract was established April 10, 1998 pursuant to sole source provisions of Section 329 of the Columbus City Code.  
 
This ordinance requests the repeal of ordinance number 0902-2007 due to incorrect language referencing "to modify and extend contract CT-19292".
 
Also, this ordinance will provide for the change of Oracle Corporation's company Federal Identification (FID) number for contracts and purchase orders currently in process and established with Oracle Corporation.  This ordinance will authorize the assignment of all past, present and future business done by the City of Columbus with Oracle Corporation from FID# 94-2871189 to FID# 84-1332677; with the contract compliance expiring on 05/07/2009.  
 
The passage of this ordinance will allow the Department of Technology to continue receiving software upgrades and support, improving the application and database performance. This contract covers a twelve month period through May 30, 2008.
 
As there is an immediate need for the Department of Technology to continue services with Oracle, this ordinance requests approval to continue services provided by Oracle in accordance with sole source provisions, of Section 329 of the Columbus City Code; as it has been determined that Oracle software can be purchased from third party vendors, however, only Oracle can supply network license, maintenance and support.  
 
EMERGENCY: There is an immediate need to enter into contract with Oracle Corporation to maintain on-going support and to allow for uninterrupted daily operations.
 
FISCAL IMPACT:  Prior year expenditure for this contract in fiscal year 2004 was $397,154.47 and in fiscal year 2005 was $434,616.73.  During fiscal year 2006, and due to credits, the contract amount established was for $59,128.59, of which the department expended, in 2006, $44,346.57 of that amount, and the balance of $14,782.02 is expected to be invoiced and expended for software maintenance and support provided by Oracle.  Funding is available in the amount of $418,831.90 for the 2007 contract period, from May 31, 2007 through May 30, 2008, within the Department of Technology, Information Services Division, Information Services Fund.  The Department of Technology has a need to reallocate $418,831.90 from an existing Auditor's Certificate (AC027309), originally established for Oracle Corporation in the amount of $418,831.90.  Currently, AC027309 has a balance of $418,831.90.

Body
WHEREAS, this legislation authorizes the Director of the Department of Technology to enter into contract with Oracle Corporation for maintenance, software support and upgrades for the city's Oracle software license, and  
 
WHEREAS, these software licenses give the city the capability to web enable these applications for citizens use and provides for users access to programs linked to Oracle applications, and
 
WHEREAS, this contract for software maintenance and upgrades that supports business management applications used citywide is for a twelve month period from May 31, 2007 through May 30, 2008, and
 
WHEREAS, the Department of Technology has a need to reallocate $418,831.90 from an existing Auditor's Certificate (AC027309) originally established for Oracle Corporation, in the amount of $418,831.90.  Currently, AC027309 has a balance $418,831.90; and
 
WHEREAS, in accordance with sole source provisions of Section 329 of the Columbus City Codes, only Oracle Corporation can supply an Oracle network site license; and
 
WHEREAS, it is necessary to repeal Ordinance Number 0902-2007; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Technology in that it is immediately necessary to authorize the Director of the Department of Technology to enter into contract for software support, maintenance and upgrade services with Oracle Corporation to maintain on-going support and daily operations, thereby protecting the public health, peace, property, safety and welfare; now, therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1. That the Director of the Department of Technology be and is hereby authorized to enter into contract with Oracle Corporation for maintenance, software support and upgrade services, in the amount of $418,831.90 for a twelve month period through May 30, 2008.
 
SECTION 2. That Ordinance Number 0902-2007, passed on July 9, 2007 is hereby repealed.
 
SECTION 3. That the City Auditor is hereby authorized to reallocate the sum of $418,831.90 from an existing Auditor's Certificate (AC027309) originally established in the amount of  $418,831.90 with Oracle Corporation; with this ordinance requesting the repeal of ordinance number 0902-2007; for the new contract with Oracle Corporation; and to expend said funds, or so much thereof as may be necessary.
 
SECTION 4. That the expenditure of $418,831.90 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 5.  That request to enter into contract with Oracle Corporation is in accordance with Section 329 (Sole Source Procurement) of the Columbus City Codes.
 
SECTION 6. That the City Auditor is authorized to make any accounting changes to revise the funding source associated with this contract modification and expenditure of funds in Section 4 above.
 
SECTION 7: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
