Explanation

 

1.                     Background

The City of Columbus, Department of Public Service, Division of Infrastructure Management, received a request from the property owner, 280 High Street LLC, asking that the City allow building elements to encroach into the public right-of-way. The project is located at 280 North High Street. This proposed building will have approximately 148 residential units, office space, building support and storage. This project is an addition and remodel of a portion of the existing building. The encroachments consist of a canopy and balconies that will extend into the right-of-way. These building elements will extend into the public right-of-way as described below and shown on the attached exhibits.

 

The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant these encroachments and legally allow the building elements to extend into the public right-of-way. Allowing the building elements to extend into the right-of-way will enhance the building and support the overall architectural character and design of the proposed building. A $500.00 value for the encroachment easements was established.

2.                     Fiscal Impact

The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachment.

Body

WHEREAS, the City of Columbus, Department of Public Service, Division of Infrastructure Management, received a request from the property owner, 280 High Street LLC, asking that the City allow building elements to encroach into the public rights-of-way. The project is located at 280 North High Street; and

 

WHEREAS, this proposed building will have approximately 148 residential units, office space, building support and storage. This project is an addition and remodel of a portion of the existing building. The encroachments consist of a canopy and balconies that will extend into the right-of-way. These building elements will extend into the public right-of-way as described below and shown on the attached exhibits; and

 

WHEREAS, the following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant these encroachments and legally allow the building elements to extend into the public right-of-way. Allowing the building elements to extend into the rights-of-way will enhance the building and support the overall architectural character and design of the proposed building; and

 

WHEREAS, a value of $500.00 was established for the encroachment easement to be deposited into fund 7748; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That Director of the Department of Public Service is hereby authorized to execute those documents necessary for the City to grant these encroachments and legally allow the building elements to extend into the public right-of-way; to-wit:

 

0.002 ACRE 3-DIMENSIONAL BALCONY ENCROACHMENT EASEMENT

BETWEEN ELEVATION OF 772.00’ TO 974.00’ (NAVD 88)

Situated in the State of Ohio, County of Franklin, City of Columbus, in Lot 10, Section 8, Township 5, Range 22, Refugee Lands, being on, over and across the right-of-way of Chestnut Street (82.5 feet wide), as dedicated by that subdivision titled, City of Columbus Inlots”, of record in Plat Book F, Page 332 (destroyed by fire), replatted in Plat Book 3, Page 247, and also represented in Plat Book 14, Page 27, to extend between an elevation of 738.21 feet to 772.24 feet (NAVD 88), being from the bottom of the lowest balcony to the roof, (all references are to the record of the Recorder’s Office, Franklin County, Ohio) and more particularly bounded and described as follows: Beginning, for reference, at the intersection of the northerly right-of-way line of said Chestnut Street with the westerly right-of-way line of Pearl Street (35 feet wide), as dedicated by said “City of Columbus Inlots”, being at the southeasterly corner of Lot 309 of said “City of Columbus Inlots”; Thence South 81° 49’ 07” West, with the northerly right-of-way line of said Chestnut Street, a distance of 18.45 feet to the TRUE POINT OF BEGINNING;

Thence across the right-of-way of said Chestnut Street, the following courses and distances:

South 08° 10' 53" East, a distance of 6.22 feet to a point;

South 81° 49' 07" West, a distance of 12.00 feet to a point; and

North 08° 10' 53" West, a distance of 6.22 feet to a point in the northerly right-of-way line thereof; Thence North 81° 49' 07" East, with said northerly right-of-way line, a distance of 12.00 feet to the TRUE POINT OF BEGINNING, containing 0.002 acre, more or less. The Vertical Datum is based on the elevation established by the Franklin County Engineering Department, monument COC 13-83, being 752.140 feet in elevation. The said monument being source benchmark with elevation that is based on the North American Vertical Datum of 1988.

SECTION 2.  That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the Director of the Department of Public Service executing and acknowledging any of those instrument(s).

 

SECTION 3. That the City will receive a total of $500.00 for granting the encroachment easements, to be deposited into Fund 7748.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
