Explanation
 
BACKGROUND:      The City's 2004 appropriation ordinances numbers 2550-2003 and 2578-2003 reflects the consolidation of the functions of the License Section, Communications Division and Weights and Measures Section into a new division called the Support Services Division.  This reorganization was necessary to better organize various operations within Public Safety in a more efficient and effective manner and reduce the need to fill vacant positions.
 
This legislation amends various sections of the Columbus City Codes and consolidates the operations of chapters  501, 1941, and 2901 into the Division of Support Services.
 
 
Body
 
WHEREAS, as proposed in the 2004 budget, the Division of Support Services will be created; and
 
WHEREAS, functions which had been performed by the Division of Communications,  the Weights and Measures section and the License Section will be consolidated into the creation of a Division of Support Services, thereby organizing operations in a more efficient manner; and,
 
WHEREAS,Chapters 217, 501, 1941 and 2901 of the Columbus City Codes should be amended to create the Division of Support Services; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
SECTION 1.  That the Columbus City Codes, Sections 217, 501, 1941, 2901 be and are hereby amended to read as follows:
 
217.01  Function of Department of Public Safety established.
 
There is established a Department of Public Safety consisting of a Director of Public Safety, a Deputy Director of Public Safety, the Division of Communications Support Services, the Division of Fire and the Division of Police.  The Department shall perform all lawful functions as may be directed by the Mayor or ordinance of Council.  (Ord.  154-84).
 
217.03        Division of  Communications Support Services.  
 
The Division of Communications Support Services  is established as a division of the Department of Public Safety.  The administrative head of the division shall be the Communications  Support Services Administrator.
 
The Division shall have as its primary duty the management of the License Section, Communications Section and Weights and Measures Section.
 
217.04      Powers and duties of the Communications Support Services  Administrator.
 
(a)The Communications Support Services  Administrator shall be the head of the Communications Support Services Division  and shall have the management of all matters and affairs pertaining thereto.
(b)He/she shall prescribe rules and regulations for the persons engaged in the service of the division, and such persons shall do and perform such duties as he may require or direct and shall be under his direction, supervision and control.  (Ord.  84-93)
 
2901.02      Office of City Sealer
 
There shall be an Office of Weights and Measures located for administrative purposes within the Department of Public Safety, Division of Support Services.  The office is charged with, but not limited to, performing the following functions on behalf of the citizens of the City.
 
a) Assuring that weights and measures in commercial service within the City are suitable for their intended use, properly installed, and accurate, and are so maintained by their owner or user.
 
(b) Preventing unfair or deceptive dealing by weight or measure in any commodity or service advertised, packaged, sold or purchased within this City.
 
(c) Making available to all users of physical standards or weighing and measuring equipment the precision calibration and related meteorological certification capabilities of the weight and measures facilities of the Office of Weights and Measures.
 
(d) Promoting uniformity, to the extent practicable and desirable, between weights and measures requirements of the City of Columbus and the State of Ohio.
 
(e) Encouraging desirable economic growth while protecting the consumer through the adoption by rule of weights and measures requirements as necessary to assure equity among buyers and sellers. (Ord. 228-94.)
501.03 Section of Licenses
 
The section of licenses is hereby created and shall be within the Department of Public Safety, Division of Support Services and shall have the power and authority granted to it under the city codes. (Ord. 1453-74.)
 
501.04 License manager.
The section shall be headed by the license manager who shall be appointed by, and be under the direct control and supervision of, the support services administrator. (Ord. 457-75; Ord. 2031-00 § 1 (part).)
 
501.06      Rules and Regulations:  
 
As provided in city codes Section 501.05, the section shall promulgate rules and regulations regarding licenses and licensing procedures. The support services administrator and the safety director shall have the authority to promulgate rules and regulations pertaining to licenses and licensing procedures as they affect the public health, safety and welfare. All rules and regulations promulgated by the section shall be in writing, approved by the License Manager, the Support Services Administrator and the Director of the Department of Public Safety, and submitted to the City Clerk as provided in city codes Section 121.05. All rules and regulations shall be posted in a conspicuous place in the offices of the section and be made available to an applicant upon request. (Ord. 457-75; Ord. 2031-00 § 1 (part).)
 
SECTION 2.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
