Title: To authorize the Director of Public Service Director to grant consent and propose cooperation with the City of Whitehall for the FRA-WHITEHALL SIGNALS (PID 90383) improvement project; to authorize the City of Whitehall to acquire right-of-way located in the City of Columbus jurisdiction on behalf of Columbus and in the City of Whitehall’s name, as necessary for the project, and for the City of Whitehall to quit claim their interest into the right-of-way located in the City of Columbus’s corporate jurisdiction to the City of Columbus after construction has been completed; and to declare an emergency. Explanation
 
1.  BACKGROUND:  To authorize consent and propose cooperation with the City of Whitehall, Ohio for the FRA-WHITEHALL SIGNALS (PID 90383) signal improvement project and to authorize the City of Whitehall to acquire right-of-way located within Columbus' corporate jurisdiction on behalf of Columbus and in and the City of Whitehall name, as necessary for the project.  Upon completion of the project, the City of Whitehall shall quit claim their interest into the right-of-way located in the City of Columbus's corporate jurisdiction to the City of Columbus after construction has been completed.  This is a joint project between City of Whitehall and the Ohio Department of Transportation (ODOT).  
 
The purpose of this project is to provide improvements to various signals at the intersections of Main Street at Country Club Drive and Fountain Lane Road.
 
Because part of the project limits is in the City of Columbus, ODOT has requested that the City of Columbus formally authorize consent through legislation for City of Whitehall to perform the work within Columbus corporate jurisdiction.  
 
2.  FISCAL IMPACT:  None
 
3.  EMERGENCY DESIGNATION:  Emergency action is requested to provide this consent to the City of Whitehall so they may maintain their project schedule.

WHEREAS, the City of Whitehall's Service Department has identified the need for the FRA-WHITEHALL SIGNALS (PID 90383) signal improvement project; and
 
WHEREAS, a part of the FRA-WHITEHALL SIGNALS (PID 90383) signal improvement project is within the Columbus corporate jurisdiction; and
 
WHEREAS, the City of Columbus grants consent and agrees to cooperate with the City of Whitehall for the FRA-WHITEHALL SIGNALS (PID 90383) signal improvement project; and
 
WHEREAS, the City of Columbus authorizes the City of Whitehall to acquire right-of-way located in the City of Columbus jurisdiction on behalf of Columbus; and
 
WHEREAS, Upon completion of the project, the City of Whitehall shall quit claim their interest into the right-of-way located in the City of Columbus's corporate jurisdiction to the City of Columbus after construction has been completed; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to pass this ordinance as an emergency measure because of the need to meet the project schedule for the FRA-WHITEHALL SIGNALS (PID 90383) improvement project for the safety of the travelling public thereby preserving the public health, peace, property, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  The City hereby grants consent to the City of Whitehall for the development and construction of the FRA-WHITEHALL SIGNALS (PID 90383) improvement project.
 
SECTION 2.  The City hereby authorizes the City of Whitehall to acquire right-of-way located in the City of Columbus jurisdiction on behalf of Columbus, and in City of Whitehall name, as necessary for the project, and for the City of Whitehall to quit claim their interest into the right-of-way located in the City of Columbus's corporate jurisdiction to the City of Columbus after construction has been completed.     
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither vetoes or approves the same.
