Explanation
BACKGROUND:
This legislation authorizes the Finance and Management Director to establish a short-term Universal Term Contract (UTC) for the option to purchase Plumbing Maintenance Services with The Waterworks, LLC. The Facilities Management Division is the primary user for Plumbing Maintenance Services. Plumbing Maintenance Services are used to maintain, service, and repair plumbing fixtures and systems in City of Columbus facilities. The term of the proposed option contract would be approximately six (6) months, expiring September 30, 2026.
The prior Plumbing Services UTC expired on February 28, 2026, and the services under that UTC were provided by The Waterworks, LLC. A short-term contract needs to be established with The Waterworks, LLC to ensure plumbing services can continue to be performed throughout City of Columbus facilities. This contract allows for services to be continued by the previous vendor while a formal bid process is conducted to establish a new, longer-term UTC. The competitive bidding provisions of Chapter 329 of the Columbus City Codes are required to be waived in order to enter this temporary contract prior to a new bid process being completed.

Emergency Designation: The Department of Finance and Management respectfully requests this legislation to be considered an emergency ordinance so that timely maintenance, service and repairs to plumbing fixtures and systems can be provided since the previous UTC has expired.
The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
FISCAL IMPACT: The expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO003264. City Agencies will be required to obtain approval to expend from their own appropriations for their estimated annual expenditures.

Body
WHEREAS, the Department of Finance and Management is in need of establishing a Plumbing Maintenance Services UTC to provide for the purchase of plumbing maintenance and repair services used to maintain, repair and update plumbing fixtures and systems while a new formal bid process is completed for a new UTC; and
WHEREAS, the Purchasing Office negotiated a contract with The Waterworks, LLC for Plumbing Maintenance Services for a period of approximately six (6) months, expiring September 30, 2026; and
WHEREAS, the prior Plumbing Services UTC, which was with The Waterworks, LLC, expired on February 28, 2026, and a short-term contract needs to be established to ensure plumbing services may continue to be performed throughout City of Columbus facilities until such time as a formal bid process is conducted to establish a new UTC; and
WHEREAS, it is in the best interest of the City to waive the competitive bidding provisions of Chapter 329 of Columbus City Codes to enter into this contract with the prior UTC vendor to make services available until a new bid process is completed; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management, Facilities Management Division in that it is immediately necessary to authorize the Finance and Management Director to enter into a Universal Term Contract for the option to purchase Plumbing Maintenance Services with The Waterworks, LLC to ensure plumbing repairs, replacements and services occur in a timely manner as the prior Plumbing Services UTC expired February 28, 2026, all for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to enter into the following universal term contract for the option to purchase Plumbing Maintenance Services for a term of approximately six (6) months, expiring September 30, 2026, as follows:
The Waterworks, LLC, All Items, $1.00
SECTION 2. That the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO003264 of this ordinance to pay the cost thereof.
SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 4. It is in the best interest of the City to waive the competitive bidding provisions of Chapter 329 of Columbus City Codes to enter into this contract.
SECTION 5. That for the reason stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
