Explanation
This ordinance authorizes the Finance and Management Director to enter into contract with Wondries Fleet Group for the purchase of seventy-five (75) police cruisers on behalf of the Division of Police. These vehicles, 2011 Crown Victoria Police interceptor sedans, are replacements for Police cruisers that are high mileage and high maintenance and need to be replaced.
These "base" vehicles are in stock by Wondries Fleet Group, a franchised Ford dealer in California. All the units will require up-fitting (the installation of light bars, cameras, communications infrastructure, etc.) which shall be contracted for separately.  Fleet Management and Support Services will work together to up-fit the 75 Cruisers prior to being placed into service. Additional legislation shall follow to complete awards for the up-fitting for all the units.  
 
The 2011 Crown Victoria model had final "build-out" dates last year - in other words they are no longer manufactured. . These units will cost approximately the same amount as similar units that were purchased by the City in late 2010 for the Division of Police. All other current production of cruisers for 2012/2013 models has been delayed throughout the country, leaving limited choices for many Police agencies. Purchasing these 75 cruisers enables the Division of Police more time to evaluate new model year units that are just now hitting the market place.   
 
A waiver of competitive bids is necessary to execute this purchase.  However, both the Public Safety Department and Finance and Management Department believe the waiver of competitive bidding to be in the best interest of the City. Otherwise, the Police Division is unlikely to have new cruisers available in 2012 to place into service.  Procuring these vehicles will permit the deployment of replacement units to be in service by early fall this year and provide time for Police to fully evaluate the next generation of cruisers that only now are getting to the market place.  
 
In addition, the Crown Victoria has been the standard Columbus Police unit for the past ten years, so Police and Fleet Management are familiar with its performance and maintenance record.  Completing this purchase with Wondries Fleet Group will ensure Police has new units in service in 2012 to replace old and high mileage units.  
 
The Finance and Management Department will be also purchasing 75 Panasonic Arbitrator digital video cameras and accessories for the new cruisers. This is from a Universal Term Contract number FL004640 with Insight Public Sector. The total for the digital video cameras and accessories is $368,601.00.  
 
These companies are not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract to the Auditor of State unresolved findings for recovery certified search.
Fiscal Impact: A total of $2,250,876.00 will be spent from the Special Income Tax Fund for vehicle replacements and digital video cameras for the Division of Police. This ordinance authorizes the appropriation and expenditure of $2,250,876.00 from the Special Income Tax Fund.
 
Emergency Action is requested so that the orders for these vehicles can be placed and older high maintenance vehicles can be removed from service.

Body
WHEREAS, the Police Division has a need to replace older and high mileage marked police cruisers; and
 
WHEREAS, the replacement of some of these vehicles would greatly reduce the maintenance expense associated with older vehicles; and
 
WHEREAS, the Police Division requires the new Police cruisers to be equipped  with digital video cameras and accessories which will be purchased from a Universal Term Contract, FL004640 with Insight Public Sector; and
 
WHEREAS, funding for the cruisers and digital video cameras and accessories is available in the Special Income Tax fund; and
 
WHEREAS, it is in the best interest of the City to waive competitive bidding provisions of Section 329.06(a) of the City Codes, 1959; and
 
WHEREAS, an emergency exists in the usual daily operations of the Division of Police, Department of Public Safety, in that it is immediately necessary to authorize the Finance and Management Director to issue a purchase order for the purchase of marked police cruisers and digital video cameras for the Division of Police, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Finance and Management Director is authorized to establish a purchase order with Wondries Fleet Group for the purchase of seventy five (75) marked patrol cruisers on behalf of the Division of Police.  
 
SECTION 2. That the City Auditor is authorized to appropriate $2,250,876.00  within the Special Income Tax Fund as follows:  Fund 430, Div 30-03; OCA 430036, Object Level Three: 6650, Amount $1,882,275.00

SECTION 3. That the expenditure of $1,882,275.00, or so much thereof as may be necessary in regard to the action authorized in Section 1, be and is hereby authorized and approved as follows:

SECTION 4. That the Finance and Management Director  is hereby authorized to issue a purchase order per the terms and conditions of a Universal Term Contract with Insight Public Sector for seventy five (75) Arbitrator 360 digital video cameras.
 
SECTION 5.  That the expenditure of $368,601.00 or so much thereof as may be necessary in regard to the action authorized in Section 4, be and is hereby authorized and approved as follows:

SECTION 6. That it is in the best interest of the City to waive the provisions of Section 329.06 (a) of the Columbus City Code, 1959; and such provisions are hereby waived.

That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
