Council Variance Application:  CV05-036
 
APPLICANT:  Columbia Gas of Ohio, Inc; c/o Michael Sucharski; 920 Goodale Boulevard; Columbus, Ohio 43212.
 
PROPOSED USE:  To allow a natural gas regulator station in the CPD, Commercial Planned Development District.
 
CITY DEPARTMENTS' RECOMMENDATION:   Approval.   The existing natural gas regulator station  has been in use since the 1970's.  The proposed station is adjacent, to the west, of the existing station.  Population growth in the area has resulted in the need for an improved station.  The Rocky Fork Blacklick Accord Implementation Panel supports the proposed station.  The applicant is providing landscaping and building designs to provide compatibility with the surrounding area.  The natural gas regulator station will not bring a new or incompatible use to the area.

To grant a Variance from the provisions of  Sections 3356.03, C-4, Commercial District; 3342.16, Parking lot; 3342.17, Parking lot screening; 3342.23, Striping and marking and 3342.24, Surface, for the property located at 6081 CENTRAL COLLEGE ROAD (43054), to permit a natural gas regulator station in the CPD, Commercial Planned Development District  (Council Variance # CV05-036).
 
 
Body
 
WHEREAS, by application No. CV05-036, the owner of property at 6081 CENTRAL COLLEGE ROAD (43054), is requesting a Council variance to permit a natural gas regulator station in the CPD, Commercial Planned Development District; and
 
WHEREAS, by Ordinance 0588-01 (Rezoning Application Z95-102A), Section 3356.03, C-4, Commercial District is utilized to identify the specific uses permitted in the CPD, Commercial Planned Development District, while the applicant desires to permit a natural gas regulator station, an institutional use, in the CPD, Commercial Planned Development District; and
 
WHEREAS,  Section 3356.03, C-4, Commercial District, prohibits a natural gas regulator station, while the applicant proposes to develop a natural gas regulator station; and
 
WHEREAS, Section 3342.16, Parking lot, requires that a parking lot, defined as one (1) or more spaces for any institutional use, must meet all of the regulations pertaining to a parking lot, while the existing parking lot does not meet all of the parking regulations; and
 
WHEREAS, Section 3342.17, Parking lot screening, requires screening for parking lots within 80 feet of residentially zoned property, while the applicant proposes a one space parking lot without said screening adjacent to a property zoned R, Rural District which is utilized for institutional uses; and
 
WHEREAS, Section 3342.23, Striping and marking, requires that each parking space shall be clearly marked, while the parking space marking is not proposed for the gravel parking lot; and
 
WHEREAS, Section 3342.24, Surface, requires a hard surface other than gravel for the parking lot and driveway while the applicant proposes to use gravel for the parking lot and driveway surface as the lot will receive limited use since no employees will be based at the location; and
 
WHEREAS, the Rocky Fork - Blacklick Accord Implementation Panel supports this variance for a natural gas regulator station; and
 
 
WHEREAS, City Departments recommend approval because the natural gas regulator station will not bring a new or incompatible use to the area.  The existing natural gas regulator station  has been in use since the 1970's.  The proposed station is adjacent, to the west, of the existing station.  Population growth in the area has resulted in the need for an improved station.  The Rocky Fork Blacklick Accord Implementation Panel supports the proposed station.  The applicant is providing landscaping and building designs to provide compatibility with the surrounding area; and   
 
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
 
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and
  
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at  6081 CENTRAL COLLEGE ROAD (43054), in using said property as desired; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  Variance from the provisions of  Sections 3356.03, C-4, Commercial District; 3342.16, Parking lot; 3342.17, Parking lot screening; 3342.23, Striping and marking and 3342.24, Surface, is hereby granted for the property located at 6081 CENTRAL COLLEGE ROAD (43054), insofar that said sections prohibit a natural gas regulator station with no parking lot screening,  no parking space marking and no hard surface for the parking lot or driveway; said property being more particularly described as follows:
 
6081 CENTRAL COLLEGE ROAD (43054), being 1.13± acres located  on the south side of Central College Road, 200 feet west of  New Albany Road West, being more particularly described as follows:

      Situate in the State of Ohio, County of Franklin, City of Columbus, lying in Section 14, Quarter Township 2, Township 2, Range 16, United States Military Lands, being part of the 0.725 acre tract conveyed to The New Albany Company, LLC by deed of record in Instrument Number 200508040157396 and part of the original 101.642 acre tract conveyed to The New Albany Company, LLC by deeds of record in Official Records 16105 D10, 12756 B15 and 21256 E01, and in Instrument Number 199811120289607, (all references refer to the records of the Recorder's Office, Franklin County, Ohio) being more particularly described as follows:
 
      Beginning, for Reference, at the centerline intersection of Central College Road with New Albany Road West, of record in Plat Book 103, Page 32-33, being North 85° 59' 39" West, a distance of 1167.02 feet from Franklin County Geodetic Survey Monument No. 5211 and South 85° 59' 39" East, a distance of 1543.82 feet from Franklin County Geodetic Survey Monument No. 5212;
 
      Thence North 85° 59' 39" West, a distance of 209.33 feet, with the centerline of said Central College Road, to a point, being the common corner of the 0.574 acre tract conveyed to Columbia Gas Transmission Corporation by deed of record in Official Record 19166 H16 and the 3.419 acre tract conveyed to The Board of Franklin County Commissioners by deed of record in Instrument Number 200309290311698;
 
      Thence South 04° 00' 21" West, a distance of 50.00 feet, with the line common to said 0.574 and 3.419 acre tracts and across the right-of-way of said Central College Road, to an iron pin set in the southerly right-of-way line thereof, being the northeasterly corner of said 0.725 acre tract and the TRUE POINT OF BEGINNING;
 
      Thence South 03° 13' 41" West, a distance of 205.00 feet, with the westerly line of said 0.574 acre tract and the easterly lines of said 0.725 and original 101.642 acre tracts, to an iron pin set;

      Bearings are based on the Ohio State Plane Coordinate System as per NAD 83, South Zone (1986 Adjustment).  Control for bearings was from coordinates of monuments Frank 5574 and Frank 5113, with a portion of Central College Road having a bearing of South 86° 09' 36" East, established by the Franklin County Engineering Department, using Global Positioning System procedures and equipment.

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a natural gas regulator station, or those uses permitted by the CPD, Commercial Development District zoning on this property (Z95-102A; ORD 0588-01).
 
SECTION 3.  That this ordinance is further conditioned that the proposed natural gas regulator station be developed in general conformance with the site plan and building elevations titled, "NEW ALBANY STATION," "BUILDING ELEVATIONS - HEATER AND FILTER BUILDING," and "BUILDING ELEVATIONS - TELEMETERING BUILDING," signed by Michael Sucharski, agent for the applicant, and dated June 12, 2006.  Any slight adjustment to the plans shall be subject to review and approval by the Director of the Department of Development, or his designee, upon submission of the appropriate data regarding the proposed adjustment.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
