Explanation
 
Background: Ordinance 0592-2005, passed April 11, 2005, authorized a $450,000 contract between the City and Columbus Urban Growth Corporation for developing a viable site master plan, land contract services, preparation of roadway construction documents and managing the construction bidding process for the roadways planned for the Northland Park site. Ordinance 1554-2006 modified the contract by adding $55,000 to cover the purchase of partially completed designs of Tamarack Boulevard from Home Depot after their decision to not occupy the site. This second modification will increase the contract amount by $270,000 to cover the preparation of an existing utilities survey, roadway alignment design changes and construction administration services for Menard's to locate on an expanded Home Depot site. The modified contract amount is $775,000.
 
Fiscal Impact: $270,000 is available in the 2007 Capital Improvements Budget, Northland Mall Project.

Body
 
WHEREAS, the Director of the Department of Development entered into a Reimbursement Agreement (DL010702) with Columbus Urban Growth Corporation (CUGC) in April 2005 to oversee the design of Northland roadways; and
 
WHEREAS,      the first modification to this contract (DL012854) was made in October 2006 to add design work for Tamarack Boulevard and $55,000 to purchase and complete the engineering drawings from and started by Home Depot; and
 
WHEREAS,      it is necessary to modify the contract again by adding $270,000 to pay for design and survey work already completed to accommodate the site to be occupied by Menard's ; and
 
WHEREAS,      these additional services have resulted in Stonehenge (the Developer) and Menard's purchasing 35 acres of the Northland Park site on March 14 and provides the finishing work necessary for the eventual purchase of the remaining 22 acres which includes the JC Penney building; now, therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.      That the Director of the Department of Development be and is hereby authorized and directed to amend DL012854 with Columbus Urban Growth Corporation by increasing the dollars allocated by $270,000 to complete all planning, survey and design work necessary to complete the roadway construction on the Northland Park development site.
 
Section 2.      That for the purpose stated in Section 1, the expenditure of up to $270,000 from the Development Department, Division No. 44-01, Northland and Other Acquisitions Fund No. 735, Project No. 441735 Northland Mall Project, OCA Code 441735, Object Level Three 6680 is hereby authorized.
 
Section 3.      That the City Auditor is authorized to make any accounting changes to revise the funding source for
all contracts or contract modifications associated with this ordinance.
 
Section 4.      That it is further agreed that in all other aspects, this contract remains unchanged.
 
Section 5.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
