Title: To authorize the Director of the Public Service Department to execute those documents required to release the platted easement located along the south side of Lot 34 of Waggoner Trace, Section 1 as shown on the plat of record in Plat Book 105, Page 73 of the Franklin County, Ohio, Recorder's Office and to declare an emergency.

Explanation
 
The Public Service Department, Transportation Division, recently received a request asking that the City release the five foot wide platted easement located along the south side of Lot 34 of Waggoner Trace, Section 1 as shown on the plat of record in Plat Book 105, Page 73, of the Franklin County, Ohio Recorder's Office.  Release of this platted easement will allow for the construction of a larger home on this corner lot.  After receipt of this request the Transportation Division verified with all the public and private utility companies that there are no utilities located within this five-foot wide platted easement and that they have no objections to the release of this easement.  A value of $500.00 was established for the release of this platted easement.  The following legislation authorizes the Director of the Public Service Department to execute those documents necessary to release the five-foot wide platted easement located along the south side of Lot 34 of Waggoner Trace, Section 1.
 
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the release of the platted easement along the south side of Lot 34 of Waggoner Trace, Section 1.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request asking that the City release the platted easement located along the south side of Lot 34 of Waggoner Trace, Section 1, as shown on the plat of record in Plat Book 105, Page 73 of the Franklin County, Ohio Recorder's Office; and
 
WHEREAS, release of this platted easement will allow for the construction of a larger home on this corner lot; and
 
WHEREAS, after receipt of this request the Transportation Division verified with all the public and private utility companies that there are no utilities located within this five foot wide platted easement and that they have no objections to the release of this easement; and
 
WHEREAS, a value of $500.00 has been established for the release of this platted easement; now, therefore
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance in order to release this easement so that the closing can proceed for the immediate preservation of the public peace, property, health and safety; now therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to release the five foot wide platted easement along the south side of Lot 34 of Waggoner Trace, Section 1, as shown on the plat of record in Plat Book 105, Page 73 60 of the Franklin County, Ohio, Recorder's Office and more fully described as follows:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, located in Quarter Township 4, Township 1, Range 16, United States Military Lands, being a strip of land across Lot 34 of that subdivision entitled "Waggoner Trace, Section 1" of record in Plat Book 105, Page 73 (all references refer to the records of the Recorder's Office, Franklin County, Ohio) being described as follows:
Beginning for reference, as the southeasterly corner of Lot 34, being in the westerly right-of-way line of Remi Drive;
Thence North 86°18'40" West, with the southerly line of said Lot 34, a distance of 5.00 feet to the TRUE POINT OF BEGINNING;
Thence North 86°18'40" West, continuing with said southerly line, a distance of 74.00 feet to a point in the existing 6 foot easement of record in Plat Book 105, Page 73;
Thence North 03°41'20" East, with the easterly line of said 6 foot existing easement, a distance of 5.00 feet to a point;
Thence South 86°18'40" East, across said Lot 34, a distance of 74.00 feet to a point in the five foot existing easement of record in Plat Book 105, Page 73;
Thence South 03°41'20" West, with the westerly line of said existing 5 foot easement a distance of 5.00 feet to the TRUE POINT OF BEGINNING, and containing 0.008 acre of land more or less.
 
Section 2.  That the $500.00 to be received by the City as consideration for the above referenced release shall be deposited in Fund 748, Project 537650.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
