Explanation

1.  BACKGROUND

The City of Columbus, Department of Public Service in engaged in the Wheatland Avenue Improvements project.  The project will consist of converting the roadway to two-way traffic between Broad Street and Glenview Boulevard and needed widening to provide for a parking lane on the west side. Improvements will consist of new curbs, sidewalks, storm sewer, electric distribution relocation, and street lighting.                     

                                                                                                         

A portion of real property owned by the City of Columbus known as 140 Wheatland Avenue, Franklin County Parcel Number 010-267201, needs to be converted to and dedicated as right-of-way for roadway purposes to accommodate the improvements contemplated by this project. Current plans identify this as Parcel 56-WD and indicate 0.0979 acres from 010-267201 will need to be converted and dedicated for this purpose, to dedicate the property as road right-of-way and name the road right-of-way as Wheatland Avenue. 

 

This ordinance permits the City to convert and dedicate the property as road right-of-way and name the road right-of-way as Wheatland Avenue.

 

2.  FISCAL IMPACT

There is no expenditure associated with this Ordinance.

To dedicate a tract of real property owned by the City of Columbus as road right-of-way; to name said public right-of way as Wheatland Avenue. ($0.00)

 

Body

WHEREAS, Ohio Revised Code Chapter 723.03 requires property to be used as a public street or alley be accepted and dedicated as public right-of-way by an ordinance specially passed for such purpose; and

 

WHEREAS, current plans indicate City owned land, totaling 0.0979 acre tract, will need to be converted and dedicated to right-of-way for this purpose; and

 

WHEREAS, the City desires to convert and dedicate a 0.0979 acre tract, as public right-of-way and name it Wheatland Avenue; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the City of Columbus hereby dedicates the following described properties as road right-of-way; to-wit:

 

Situated in the State of Ohio, Franklin County, City of Columbus, Survey Number 2668, Virginia Military District, being a 12.501 acre residue of an original 20.098 acre tract as conveyed to The City of Columbus.  Prior instrument reference as of the date this survey was prepared: Instrument Number 200307020202150, of Franklin County, Ohio.  Being bounded and described as follows:

 

Commencing at a 1” iron pipe found along the easterly right-of-way line of Wheatland Avenue (40’ wide) and being the southwest corner of 256.308 acre tract as conveyed to the State of Ohio in Deed Book 101, Page 390, said pipe found also being at the northwest corner of said 12.501 acre tract, being 20.00’ right of the Wheatland Avenue centerline station 33+50.53 and being the True Point of Beginning;

 

Thence N 78°06’21” E a distance of 6.01’ along the southerly property line of said State of Ohio tract and also being along the north property line of said 12.501 acre tract to an iron pin set, 26.00’ right of the Wheatland Avenue centerline station 33+50.89;

 

Thence leaving the southerly right-of-way line of said State of Ohio tract and through said The City of Columbus tract the following (3) three courses;

 

1.)                      S 08°24’17” E a distance of 399.94’ to an iron pin set, 26.00’ right of the Wheatland Avenue centerline station 29+50.96;

 

2.)                      S 13°33’45” E a distance of 77.86’ an iron pin set, 33.00’ right of the Wheatland Avenue centerline station 28+73.41;

 

3.)                     S 08°24’17” E a distance of 86.76’ an iron pin set on the northerly property line of a 3.098 acre tract as conveyed to Wheatland Crossing Limited Partnership, an Ohio Limited Partnership in Instrument Number 201611070153952, said iron pin set also being on the south property line of said 12.501 acre tract, being 33.00’ right of the Wheatland Avenue centerline station 27+86.65;

 

Thence S 81°35’58” W a distance of 13.00’ along the northerly property line of said Wheatland Crossing Limited Partnership, an Ohio Limited Partnership tract and also being along the south property line of said 12.501 acre tract to an iron pin found at the northwest corner of said Wheatland Crossing Limited Partnership, an Ohio Limited Partnership tract and being the easterly right-of-way line of said Wheatland Avenue, said pin found also being 20.00’ right of the Wheatland Avenue centerline station 27+86.65;

 

Thence N 08°24’17” W a distance of 563.88’ leaving the northwest corner of said Wheatland Crossing Limited Partnership, an Ohio Limited Partnership tract and along the westerly property line of said 12.501 acre tract and also being said easterly right-of-way line of Wheatland Avenue to the True Point of Beginning;

 

The above described area contains 0.0979 acres of land, more or less, of which the present road occupies 0.000 acres of land, being part of Franklin County Auditor’s Parcel Number 010-267201

 

All references here in are to records in the Recorders Office, Franklin County, Ohio.

Grantor claims title by Instrument Number 200307020202150.

The basis of bearings for this description are based Geodetic North of the Ohio State Plane Coordinate System, South zone, NAD83 (2007) as determined from GPS observations utilizing the ODOT RTN with Wheatland Avenue being N 08°24’17” W.

All stations and offsets here in are referenced to the centerline of existing right-of-way of Wheatland Avenue as shown upon the right-of-way plan “Improvements of Wheatland Avenue from W Broad Street to Oakley Avenue “on file with the City of Columbus, Ohio.

All pins set are 5/8 inch rebar, 30 inches long, with a yellow cap reading “NEAS, INC”.

 

This description was prepared under the direction of Charles W. Price Jr., Registered Professional Surveyor, No. 7825.

 

This description is based on a field survey in November, 2022 prepared under the direct supervision of Michael Jay Wilson, Registered Professional Surveyor, No. 8281.

 

SECTION 2.  That the City of Columbus hereby converts and dedicates the above described road right-of-way as Wheatland Avenue.

 

SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
