Explanation
BACKGROUND:
This ordinance will authorize the Director of the Department of Technology to renew an annual agreement (Service Contract #1488945) with Oracle America, Inc. for annual software maintenance and support for database and server software that supports citywide business management applications.  The original agreement (CT-19292) was established April 10, 1998 by authority of ordinance 569-98.  The agreement was most recently renewed by authority of ordinance 0237-2011, passed April 4, 2011, through purchase order EL011734.  This renewal will provide annual maintenance and support for the period May 31, 2012 to May 30, 2013, at a cost of $411,763.41.
Oracle software is a critical component of a number of citywide business systems; including 311, CUBS, Performance Series, Income Tax, and GIS. The software is server based and has given the City the capability to web enable applications for citizens' use and ensure compliance with licensing agreements.  
 
This ordinance also requests approval to continue services provided by Oracle America, Inc. and waive competitive bidding provisions of section 329 of the Columbus City Code.  The City attempted to purchase Oracle maintenance and support through solicitation SA004337.  The lowest and best offer in response to the solicitation, received April 12, 2012, costs more than purchasing annual maintenance and support directly from Oracle.
 
FISCAL IMPACT:    
During fiscal years 2010 and 2011, $388,126.51 and $399,770.31 were expended respectively with Oracle America, Inc. for annual software maintenance and support.  Funding is available in the amount of $411,763.41 for the 2012 contract period, within the Department of Technology, Information Services Division, internal service fund.
 
EMERGENCY:  
Emergency action is requested to expedite authorization of this contract in order to initiate services from the supplier at the prices proposed; to continue with services that are necessary to support daily operation activities; to ensure no service interruption.

WHEREAS, this legislation authorizes the Director of the Department of Technology to renew an annual contract with Oracle America, Inc. for maintenance, software support and upgrades for the city's Oracle software license, and  
 
WHEREAS, these software licenses give the city the capability to web enable these applications for citizens use and provides for users access to programs linked to Oracle applications, and
 
WHEREAS, this contract renewal is for annual software maintenance and upgrades that support business management applications used citywide is for a twelve month period from May 31, 2012 through May 30, 2013, and
WHEREAS, this ordinance requests to waive the competitive bidding provisions of the Columbus City Code, under Section 329; and
WHEREAS, an emergency exists in the daily operation of the Department of Technology, in that it is immediately necessary to authorize the Director of the Department of Technology to renew an annual contract with Oracle America, Inc. to provide maintenance, software support and upgrades for daily operations, thereby protecting the public health, peace, property, safety and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1: That the Director of the Department of Technology be and is hereby authorized to renew an annual contract with Oracle America, Inc. for maintenance, software support and upgrade services, in the amount of $411,763.41 for a twelve month coverage period from May 31, 2012 through May 30, 2013.
 
SECTION 2: That the expenditure of $411,763.41 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 3: That the City Auditor is authorized to make any accounting changes to revise the funding source associated with this contract modification and expenditure of funds associated with this contract.
SECTION 4: That for good causs shown, the competitive bidding provisions of the Columbus City Codes Section 329.07 are hereby waived.
SECTION 5: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
