Explanation
BACKGROUND: This ordinance authorizes the Public Service Director to enter into contract for the Facilities Management Division with Fox Mechanical Company, in the amount of $554,000.00 for the final portion of the plumbing renovations at City Hall. The existing plumbing is approximately 75 years old and is in its original form. The capacity of the supply lines are approximately half of original capacity and many valves are stuck open permanently. Drain lines are thin, making it very difficult to open a clogged drain. The project will involve the replacement of the main domestic water piping throughout half of City Hall, and the replacement of valves and drains as needed. Soil, waste, and vent piping will also be repaired and replaced as necessary. Plumbing fixtures such as toilet room fixtures, sinks, freeze proof hydrants, and electric water coolers shall be replaced. The contractor will also fix any damage to the building caused during the repair of the plumbing. The first portion of the City Hall plumbing renovation cost $405,600.00. It began in April 2004 and was completed in October 2004. The duration of this contract is three hundred calendar days from the contract award date.
Formal proposals were solicited on January 18, 2005, and bids were received on February 15, 2005, as follows (0 MBE, 1 FBE*):

It is the recommendation of the Facilities Management Division to award this contract to Fox Mechanical Company. In a letter dated February 17, 2005, Farber Corporation withdrew its bid, citing a major mathematical error. TP Mechanical Contractors failed to provide the necessary 10% Proposal Bond.
Emergency action is requested to allow this project to proceed in a timely manner so that the plumbing at City Hall may be repaired as soon as possible.
Fiscal Impact: The Facilities Management Division budgeted $664,475.00 in the 2004 Capital Improvement Budget for the final phase of City Hall plumbing. The cost of this contract is $554,000.00. Fox Mechanical Company Contract Compliance Number 31-1270804, exp. 03/11/2007.

($554,000.00).
Body
WHEREAS, the plumbing in City Hall has deteriorated and it is necessary to replace and repair this plumbing, and
WHEREAS, the first phase of this replacement was completed in October 2004, and
WHEREAS, the Facilities Management Division recommends Fox Mechanical Company as the most responsive and responsible bidder, and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Facilities Management Division, in that it is immediately necessary to commence with renovations to the existing plumbing system in City Hall to make the system serviceable, thereby preserving the public health, peace, property, safety and welfare, now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director is hereby authorized to contract with Fox Mechanical Company for City Hall plumbing renovations located at 90 West Broad Street.
SECTION 2. That the expenditure of $554,000.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.
