Title: To authorize and direct the Finance and Management Director to modify the citywide contract for the option to obtain Collection, Sale & Recycling of Mixed Recovered Office By-Products, and to declare an emergency.
Explanation
 
Background: To modify the existing city-wide contract for the Collection, Sale & Recycling of Mixed Recovered Office By-Products for use by various City agencies to permit a price increase $6.00 per month for the first wastewheeler at each location.  Formal bids were opened by the Purchasing Office on June 9, 2005. The Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06. (Proposal No. SA001650). FL002922, with Rumpke of Ohio, Inc. was established in accordance with bids received thru December 15, 2011 and did not include an escalator clause.  
Contract compliance number is 311617611, which expires 3/21/2010.
1. Amount of additional funds: The estimated annual expenditure for the contract is $50,000.00. The various City agencies must obtain approval to expend from their own budgeted funds for their estimated expenditures.
2. Reason additional needs were not foreseen: Due to the unexpected increases in fuel costs from the time of the original bid, Vendor requires this price increase.
3. Reason other procurement processes not used: The same exact service is required as originally bid. No lower pricing/more attractive terms and conditions are anticipated at this time.
4. How cost was determined: The cost increase was negotiated with the vendor, terms and conditions are in accordance with the original agreement.
The company is not debarred according to the Federal Excluded Parties Listing or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
This ordinance is being submitted as an emergency because, without emergency action, no less than 37 days will be added to this procurement cycle and the efficient delivery of valuable public services will be slowed.
 
FISCAL IMPACT: No funding is required to modify the option contracts. The various City agencies must set aside their own funding for their estimated expenditures.

To authorize and direct the Finance and Management Director to modify the citywide contract for the option to obtain Collection, Sale & Recycling of Mixed Recovered Office By-Products, and to declare an emergency.
 
Body
 
WHEREAS, the Purchasing Office advertised and solicited formal bids, and selected the lowest bid; and
WHEREAS, vendor has agreed to modify FL002922 to include a price increase from $40.00 to $46.00 per month for the first wastewheeler at each location, and it is in the best interest of the City to modify this contract; and
WHEREAS, an emergency exists in the usual daily operation of the various City agencies in that it is immediately necessary to modify this contract for an option to obtain Collection, Sale & Recycling of Mixed Recovered Office By-Products, thereby preserving the public health, peace, property, safety, and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Finance and Management be and is hereby authorized and directed to modify  FL002922 with Rumpke of Ohio, Inc. to include a price increase from $40.00 to $46.00 per month for the first wastewheeler at each location.
SECTION 2. That this modification is in accordance with Section 329.16 of the Columbus City Codes.
SECTION 3. That for the reason stated in the preamble here to, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
