BACKGROUND:   
This legislation authorizes the Director of the Department of Technology and the Director of the Department of Building and Zoning Services, to renew an annual subscription service contract for user access licenses and support with the National Fire Protection Association (NFPA) electronic fire codes, associated with building inspectors and plans examiners in the amount of $27,500.00 (100 users @ $275.00/ea), with a term period of June 28, 2011 through June 27, 2012.  Also, this contract will provide for web access for use of numerous NFPA copyright codes and standards materials associated with various aspects of fire prevention and protection. The original agreement was authorized by authority of ordinance 0881-2010, passed by Council June 28, 2010. This is the first renewal associated with that agreement.
 
For approximately ten years, the Department of Building and Zoning Services began utilizing services from NFPA, associated with the electronic fire codes.  At that time, the agency purchased code books for staff utilization.   As the code books' cost began to increase, the agency began to research other methods to view and access the necessary data.  Out of this research the agency switched to web access for staff.  This web access was obtained via a three (3) user license that could be shared among staff.  However, the NFPA has restructured their access procedures whereby the Department of Building and Zoning Services can no longer have multi-users sharing access from the three (3) user license.  As a result of this restructure, it is necessary to upgrade the current license, thus allowing for the level of needed access and shared access for various staff use. Without the passage of this legislation, the ability to provide accurate, timely, up-to-date fire protection code information to the Department of Building and Zoning Services' user base of building inspectors and plans examiners will not be available.
 
National Fire Protection Association is the sole owner of the codes, standards, books, audio/visual and electronic materials dealing with various aspects of fire prevention and protection. As such, this contract is being established in accordance with the sole source provisions of the Columbus City Code, Section 329.07.
 
FISCAL IMPACT:
In 2009, the cost incurred for three users was $2,362.50, however in 2010 (as a result of NFPA's restructure for access) $27,500.00 was legislated for a 100 user subscription license service for access and support with the National Fire Protection Association. The cost associated with this contract renewal is $27,500.00. Funds have been identified and are available within the Departmemt of Technology Internal Services Fund for the Department of Building and Zoning Services. The aggregate contract total including this request is $55,000.00.

WHEREAS, National Fire Protection Association is the owner of the codes, standards, books, audio/visual and electronic materials dealing with various aspects of fire prevention and protection, and  
 
WHEREAS, without the passage of this legislation, the Department of Building and Zoning Services will lose the ability to provide accurate, timely up-to-date fire protection code information to the Department of Building and Zoning Services' user base of building inspectors and plans examiners, and
 
WHEREAS, this agreement is being established in accordance with the sole source provisions of the Columbus City Code, Section 329.07
 
WHEREAS, this subscription service contract renewal is needed in order for the Department of Building and Zoning Services to continue providing fire protection code information service to their user inspectors and examiners, to allow for uninterrupted daily operations for the preservation of the public health, peace, property, safety and welfare; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1: That the Director of the Department of Technology and the Director of the Department of Building and Zoning Services, be and hereby authorized to renew an annual subscription service contract for user access licenses and support with the National Fire Protection Association (NFPA) electronic fire codes; associated with building inspectors and plans examiners, with a coverage period from June 28, 2011 through June 27, 2012.  The cost associated with this ordinance is $27,500.00.
 
SECTION 2: That the expenditure of $27,500.00 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 3: That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
