Explanation

 

Background: This ordinance authorizes the Director of Public Safety, on behalf of the Division of Fire, to modify all contracts and agreements with Argus Group Holdings dba Premier Safety by assigning past, present and future contracts and agreements to MES I Acquisition Inc. dba MES Life Safety LLC.  The Division of Fire needs to ensure funding is available for the maintenance and repair of its HAZMAT equipment. This equipment is vital to the life-saving operations of the Division of Fire’s HAZMAT team. 

 

The Division of Fire previously executed a contract on February 27, 2024 with Argus Group Holdings dba Premier Safety for maintenance and repair of HAZMAT equipment services from March 1, 2024 to February 28, 2025.  It was recently learned that the company had been acquired by MES I Acquisition Inc. dba MES Life Safety LLC and that the company had changed their name and Federal Identification Number.  Therefore, this Ordinance authorizes the assignment of all past, present and future business done by the Division of Fire with Argus Group Holdings dba Premier Safety, FID #45-5282127, to be reassigned to MES I Acquisition Inc. dba MES Life Safety LLC, FID #20-2019745.

The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.

 

Fiscal Impact:  No additional funds are requested at this time.  Funds from purchase order #PO433427 will be utilized to establish the new contract with MES I Acquisition Inc. dba MES Life Safety LLC after this Ordinance has passed.

Emergency Designation:  This ordinance is being submitted as an emergency to allow for the utilization of continued maintenance and repair of the Division of Fire’s HAZMAT equipment, and to provide the necessary establishment of funding under the new company name and FID number to allow for the payment of services for all past, present and future business done by the Division of Fire with MES I Acquisition Inc. dba MES Life Safety LLC.

Body

 

WHEREAS, the Division of Fire has a need to ensure funding is available for the maintenance and repair of the Division of Fire’s HAZMAT equipment; and

 

WHEREAS, the Division of Fire previously entered into a contract with Argus Group Holdings dba Premier Safety for the necessary maintenance and repair of the Division of Fire’s HAZMAT equipment; and

 

WHEREAS, this Ordinance authorizes the assignment of all past, present and future business done by the Division of Fire with Argus Group Holdings dba Premier Safety FID #45-5282127, to be reassigned to MES I Acquisition Inc. dba MES Life Safety LLC, FID #20-2019745; and

 

WHEREAS, an emergency exists in the usual daily operation of the Division of Fire in that it is immediately necessary to allow for the continued use of HAZMAT equipment maintenance and repair services without interruption, and to provide the necessary establishment of funding under the new company name and FID number to allow for the payment of services for all past, present and future business done by the Division of Fire with MES I Acquisition Inc. dba MES Life Safety LLC, for the immediate preservation of the public health, peace, property and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS;

 

SECTION 1.  That the Director of the Department of Public Safety, on behalf of the Division of Fire be and is hereby authorized to modify all past, present and future contracts and agreements pursuant to those contracts to reflect the change of company name and FID number from Argus Group Holdings dba Premier Safety, FID #45-5282127, to MES I Acquisition Inc. dba MES Life Safety LLC, FID #20-2019745.

 

SECTION 2.  That this modification is in accordance with the pertinent provisions of Chapter 329 of the Columbus City Codes.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
