Explanation

 

The Department of Public Utilities would like to enter into the fifth modification of contract EA024824 with Decker Construction Company, for the Utility Cut and Restoration Project, whose focus is to repair damaged items such as pavements, curbs, and sidewalks.  The Contract Compliance Number for Decker Construction Company is 31-0983557.  They do not have MBE/FBE status.

 

1.  The Division needs an additional $490,000.00.  The original contract was established for $350,000.00.  The total amount of the original contract and five modifications is $3,220,747.00.

2.  This modification is to establish additional funds for this contract.

3.  Work under this modification is a continuation of services performed by the company.

4.  Decker Construction is holding over the same prices from modification number four.

 

It is requested that this Ordinance be handled in an emergency manner, as the funds in the current contract are low, and we would like to pay the company without an interruption of service.

 

FISCAL IMPACT: The Division of Water allocated $490,000.00 in its 2003 Budget for these services. 

 

$   850,000.00 was expended for these services during 2002.

$1,180,747.00 was expended for these services during 2001.

To authorize the Director of Public Utilities to enter into the fifth modification of the contract with Decker Construction Company, for the Utility Cut and Restoration Project, for the Division of Water, to authorize the expenditure of $490,000.00 from Water Systems Operating Fund, and to declare an emergency.  ($490,000.00)

 

 

Body

 

WHEREAS, contract EA024824 was authorized by Ordinance 1671-00, passed July 10, 2000, allowing the Director of Public Utilities to enter into a three-year contract with Decker Construction Company for the Utility Cut and Restoration Project, and

 

WHEREAS, it is necessary to extend this contract another year to provide funds for repairs to City pavements, curbs, and sidewalks as the result of utility excavations, and

 

WHEREAS, it has become necessary in the usual daily operation of the Division of Water, Department of Public Utilities, to authorize the Director of Public Utilities to modify and increase the contract for the Utility Cut and Restoration Project, for the Distribution activity, for the preservation of public health, peace, property and safety; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the Director of Public Utilities be and is hereby authorized to modify and increase the contract with Decker Construction Company, for the Utility Cut and Restoration Project, for the Division of Water, Department of Public Utilities.

 

Section 2.  That the expenditure of $490,000.00 or as much thereof as may be needed is hereby authorized from Water Works Fund 600, Department 60-09, Object Level One 03, Object Level Three 3375, OCA Codes and amounts listed below, to pay the cost thereof.

Section 3.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
