Explanation
 
Memorandum of Understanding #2005-01 was executed by representatives of the City and FOP/Ohio Labor Council, Inc.   This MOU changes the language in Section 14.4 of the collective bargaining agreement to authorize the City to pick-up the additional .5% of employee conributions effective January 1, 2006 and January 1, 2007.  The passage of this ordinance indicates Council's acceptance of Memorandum of Understanding #2005-01, a copy of which is attached hereto.
 
Emergency action is recommended in order to implement the change prior to the first pay period of 2006, January 1.
 
FISCAL IMPACT:  The cost associated with the acceptance of this MOU has been included in the 2006 proposed budget.

To accept Memorandum of Understanding #2005-01 executed between representatives of the City of Columbus and FOP/Ohio Labor Council, Inc., which amends the Collective Bargaining Contract, April 2, 2004-April 1, 2007; and to declare an emergency.
 
Body
 
WHEREAS, representatives of the City and FOP/Ohio Labor Council, Inc. entered into Memorandum of Understanding #2005-01, a copy of which is attached hereto, to amend the Collective Bargaining Contract between the City and FOP/Ohio Labor Council, Inc., April 2, 2004-April 1, 2007, by amending Section 14.1; and
 
WHEREAS, an emergency exists in the usual daily operation of the City in that it is immediately necessary to amend the Collective Bargaining Contract between the City and FOP/Ohio Labor Council, Inc., by accepting Memorandum of Understanding #2005-01 thereby preserving the public peace, property, health, safety, and welfare; Now, Therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That Memorandum of Understanding #2005-01 amends the Collective Bargaining Contract between the City and FOP/Ohio Labor Council, Inc., April 2, 2004-April 1, 2007.
 
Section 2.  That City Council, in the best interests of the City, hereby recognizes and accepts Memorandum of Understanding #2005-01, a copy of which is attached hereto, executed between representatives of the City and FOP/Ohio Labor Council, Inc., to be effective at the beginning of the first pay period in 2006 (January 1).
 
Section 3. For the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
