Explanation

 

1.                     Background

The City of Columbus, Department of Public Service, received a request from the owner of the site, Franklin County Board of Commissioners, asking that the City allow a Security Booth to encroach into the public right-of-way. This encroachment consist of one booth along the north side of West Fulton Street, east of South Front Street and parallel to parcel 010-055568. This project consist of a Security Booth next to the existing Franklin County building. This encroachment is located within the right-of-way as indicated above and the easement as described below and within the attached exhibit.

 

The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant this encroachment and legally allow the Security Booth into the public rights-of-way. Allowing this element into the public right-of-way will allow for the building to have secure and safe access and deliveries. A value of $500.00 for the encroachment easement was established.

 

2.                     Fiscal Impact

The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachments.

WHEREAS, the following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant this encroachment and legally allow the Security Booth into the public rights-of-way. Allowing this element into the public right-of-way will allow for the building to have secure and safe access and deliveries; and

 

WHEREAS, a value of $500.00 for the encroachment easements was established; and

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  Authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant this encroachment and legally allow the Security Booth into the public rights-of-way. Allowing this element into the public right-of-way will allow for the building to have secure and safe access and deliveries; to-wit:

 

3 Dimensional Encroachment Easement

FROM ELEVATION 754.00 feet (NAVD88) and the top is 767.00 feet (NAVD 88)

 

Situated in the State of Ohio, County of Franklin, City of Columbus, lying on, over and across the right-of-way of West Fulton Street, 82.5’ R/W, as dedicated to the City of Columbus by the Town Plat of the City of Columbus, Deed Book “F” page 332, destroyed by fire, replatted in Plat Book 3 page 247 and also represented in Plat Book 14 and 27 (All records are on file at the Recorder’s Office, Franklin County, Ohio) and being bounded and more particularly described as follows:

This description has a vertical component. The intent of this description is to include an area from an elevation below the subgrade at the bottom of the bollards up to an elevation at the top of the security booth. The bottom of the area is 754.00 feet (NAVD88) and the top is 767.00 feet (NAVD 88). The elevations given go along with the horizontal metes and bounds described below, creating an extruded block of air-space.

Commencing at the corner of the northeasterly intersection of W. Fulton Street and S. Front Street, 82.5’ R/W, and the southwesterly corner of Inlot 229 of said Town Plat;

Thence North 82° 00’ 08” East, following along the southerly line of Inlot 229 and the northerly right-of-way of W. Fulton Street, for a distance of 2.75 feet to a point having an elevation of 754.00 (NAVD 88) to 767.00 (NAVD88) and being the True Place of Beginning of the parcel herein described;

Thence North 82° 00’ 08” East, continuing along the line thereof, for a distance of 19.00 feet to a point having an elevation 754.00 (NAVD 88) to 767.00 (NAVD88);

Thence passing through the right-of-way of W. Fulton Street for the following three (3) courses and distances;

1.                     South 07° 59’ 52” East, for 8.50 feet to a point having an elevation of 754.00 (NAVD 88) to 767.00 (NAVD88);

2.                     South 82° 00’ 08” West, for 19.00 feet to a point having an elevation of 754.00 (NAVD 88) to 767.00 (NAVD88);

3.                     North 07° 59’ 52” West, for 8.50 feet to the True place of Beginning and containing 162 square feet or 0.004 acres of land, more or less.

Bearings for this description are based on the southerly right-of-way of W. Fulton Street along Inlot 229 as being North 82° 00’ 08” East as determined by a RTN/GNSS Survey on November 20, 2023, and referenced to the Ohio State Plane Coordinate System, South Zone, NAD 83(2011) Epoch 2010.0.

The elevations are based on the North American Vertical Datum of 1988 (NAVD 88, Geoid 18). Elevations were established using GPS observations of control points utilizing the Ohio Department of Transportation’s RTN. All other elevations were calculated from proposed dimensions and the established elevations from local benchmarks.

This description was prepared by Chad S. Snow, Registered Surveyor No. 8559 and is based on an actual field survey performed by MS Consultants, Inc. in January 2024.

 

SECTION 2.  That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the director of the Department of Public Service executing and acknowledging any of those instrument(s). 

 

SECTION 3. That the City will receive a total of $500.00 to be deposited in Fund 7748, Project P537650, for granting the requested easement.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
