Explanation

 

AN05-007

BACKGROUND:                     This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN05-007 a certain petition for annexation as described in the ordinance and transcript which is attached hereto. More than sixty days have elapsed since July 18, 2005, the date of receipt from the Board of County Commissioners of Franklin County.

 

These are submitted in accordance with the Ohio Revised Code.

 

FISCAL IMPACT:                     Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.

 

Title

 

To accept the application (AN05-007) of Cardinal Title Holding Co. for the annexation of certain territory containing 4.041 ± Acres in Plain Township.

 

Body

 

WHEREAS,   a petition for the annexation of certain territory in Plain Township was duly filed by Cardinal Title Holding Co. on April 27, 2005; and

 

WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated June 7, 2005; and

 

WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on July 18,2005; and

 

WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and

 

WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore, 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

 

Section 1.  That the proposed annexation as applied for in the petition of Cardinal Title Holding Co. being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio April 27, 2005 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated June 7, 2005, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:

 

Situated in the State of Ohio, County of Franklin, Township of Plain, Quarter Section 3,Township 2, Range 16, United States Military Lands and being all of a 1.951 acre tract of land as conveyed to Cardinal Title Holding Company of record in Instrument Number 200307080207589 and being all of a 1.795 acre tract of land as conveyed to Cardinal Title Holding Company of record in Instrument Number 200209060222038 and also being a residual 0.072 acre tract of land as conveyed to Cardinal Title Holding Company, Auditor's Parcel 220-000260 (Originally conveyed to Lawrence F. and Cynthia J. Irwin of record in Official Record Volume 18592, Page D-08 (all records being of the Auditor's Office and the Recorder's Office Franklin County, Ohio) and being more particularly described as follows:

 

Beginning for reference at the centerline intersection of Warner Road with the centerline intersection of Hamilton Road as recorded in Plat Book 100, Page 3 and being referenced from a monument (FCE 1207) located South 86°17'30" East, a distance of 699.74 feet;

 

Thence North 86°17'30" West with the centerline of said Warner Road, a distance of 359.55 feet to a point;

 

Thence South 01°03'00" West crossing said Warner Road and with the westerly corporation line of the City of Columbus (Ordinance Number 2982-86 as recorded in Official Record Volume 8860, Page E-19), a distance of 40.04 feet to a point on the southerly right of way line of said Warner Road and being the true point of beginning;

 

Thence South 01°03'00" West with said westerly corporation line together with the easterly line of said 1.795 acre tract of land and with the westerly line of 33.918 acre tract of land as conveyed to Cardinal Title Holding Company of record in Official Record Volume 124417, Page G-06, a distance of 460.46± feet to the southeasterly corner of said 1.795 acre tract of land and also being the southwesterly corner of said corporation line and also being a corner of said 33.918 acre tract of land;

 

Thence North 86°17'30" West with the southerly lines of said 1.795 acre tract of land and said 1.951 acre tract of land together with the northerly line of said corporation line and the northerly line of said 33.918 acre tract, a distance of 339.86± feet to the southwesterly corner of said 1.951 acre tract of land and also being the southwesterly corner of said 0.072 acre tract of land and the southeasterly corner of the City of Columbus corporation line, Ordinance Number 1387-97 as recorded in Instrument Number 199710070113535 and a corner of said 33.918 acre tract;

 

Thence North 00°30'08" West leaving said corporation line (Ordinance Number 2982-86) and with the westerly line of said 0.072 acre tract of land together with the easterly corporation line of said Ordinance Number 1387-97 together with the easterly line of a 2.684 acre tract of land as conveyed to Cardinal Title Holding Company of record in Official Record Volume 34190, Page D-13, a distance of 481.26± feet to a point on the southerly right of way line of said Warner Road;

 

Thence South 86°17'30" East and being 20.00 feet southerly and at right angles with the centerline of said Warner Road, a distance of 182.91± feet to a point on the westerly line of the City of Columbus corporation line Ordinance Number 637-022 as recorded in Instrument Number 200208300215308;

 

Thence with the southerly right of way line of said Warner Road together with the southerly line of said corporation line, the following two (2) courses;

 

1)                     South 01°02'02" West, a distance of 20.02± feet to a point;

 

2) South 86°17'30" East, a distance of 169.99± feet to the true point of beginning and containing 3.739 acres of land more or less.

 

Together with the following described 0.302 Acre right of way on Warner Road;

 

Situated in the State of Ohio, County of Franklin, Township of Plain and being a 0.302 acre tract as conveyed to the City of Columbus of record in Official Record Volume 23562 Page G04 located in Quarter Township 3, Range 16, United States Military Lands and being described as follows:

 

Beginning for reference at the centerline intersection of Warner Road with the centerline intersection of Hamilton Road as recorded in Plat Book 100, Page 3 and being referenced from a monument (FCE 1207) located South 86°17'30" East, a distance of 699.74 feet;

 

Thence South 86°17'30" East with the centerline of said Warner Road, a distance of 80.20± feet to a point westerly corporation of the City of Columbus (Ordinance Number 898-00 Case No. 67-99);

 

Thence South 04°12'30" West with said line a distance of 30.00± feet to a point;

 

Thence North 86°17'30" West with the existing corporation line of the City of Columbus ( Ordinance Number 2982-86 recorded in Official Record Volume 8860 page E-19) a distance of 438.10± feet to a point of the easterly corporation line of the City of Columbus ( Ordinance Number 637-02 recorded in Inst. No. 200208300215308 );

 

Thence North 01°03'00" East with said corporation line a distance of 30.03± feet to the centerline of said Warner Road;

 

Thence South 86°17'30" East with said centerline and being on the southerly of the corporation line of the City of Columbus (Ordinance Number 637-02) a distance of 359.55± feet to the true point of beginning and containing 0.302 acres for a total acreage of 4.041 acres of land more of less.

 

Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

 

Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
