Explanation
BACKGROUND:
Need: The Division of Fire has been awarded a grant from the Department of Homeland Security to purchase a MSA Safe Site for the Bomb Squad. The total cost of the system will be $100,298.00 and payment will be issued by Franklin County. The City of Columbus and Franklin County entered into an Intergovernmental Agreement via Ordinance 1917-2005 to enable this type of purchase; the agreement, which has recently expired, is being extended via Ordinance 1691-2006. This ordinance is contingent on the passage of Ordinance 1691-2006.
This legislation will authorize and direct the Director of Finance & Management to execute those documents necessary for the acquisition of this equipment; there is no expenditure for this equipment, as Franklin County will administer the payment of the upgrade upon legislative approval.
Bid Information: The Division of Fire has an immediate need to purchase a MSA Safe Site Threat Detection System to be used by the Bomb Squad. Formal bids were solicited via SA002128 with I.E. Monitoring Instruments Inc. submitting the sole responsive bid. The Captain of the Columbus Bomb Squad determined after the opening of the bids, that a chemical detection component included in Line Item #2 of the Bid Proposal was redundant and a significant reduction to the cost of this detector could be realized if the company changed the configuration. The company has agreed to change the configuration of said detector and thus save a considerable amount in cost.
Competitive bidding is being waived for this purchase to take advantage of the cost lowing counter proposal offered by I.E. Monitoring Instruments Inc.

Emergency Designation: This legislation is to be declared an emergency measure due to it being imperative that legislative approval occur prior to expiration of the grant period.

Budgeted Amount: There is no expenditure associated with this ordinance.

WHEREAS, the Division of Fire has been awarded a grant from the Department of Homeland Security to purchase a MSA Safe Site for the Bomb Squad; and
WHEREAS, formal bids were solicited by the Purchasing Office via SA002128 with I.E. Monitoring Instruments, Inc. submitting the best bid; and
WHEREAS, specifications submitted by the Fire Division prevent the award without a waiver of competitive bidding; and
WHEREAS, an emergency exists in the daily operation of the Division of Fire, Department of Public Safety, in that it is necessary to authorize and direct the Director of Finance & Management to execute those documents necessary for the acquisition of said blast mitigation system prior to the expiration of the grant period, for the preservation of the public health, peace, property, safety and welfare; Now, therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That the Director of Finance & Management be and is hereby authorized and directed to execute those documents necessary for the acquisition of a MSA Safe Site for the Division of Fire's Bomb Squad.
Section 2. There is no expenditure for this equipment, as the Franklin County Emergency Management Agency will administer the payment of the upgrade upon legislative approval.
SECTION 3. This Council finds it is in the best interest of the City of Columbus to waive the provisions of Section 329.06 of the Columbus City Codes to permit the aforementioned purchase.
Section 4. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
