Title: To authorize the City Attorney to modify an existing contract with Exponent for consulting services in connection with the Town Street Bridge, to authorize the expenditure of an additional Twenty Three Thousand, One Hundred Forty Two and 57/100 Dollars ($23,142.57), to waive the competitive bidding provisions of the Columbus City Codes, and to declare an emergency.
Explanation
This ordinance authorizes the City Attorney to modify a contract entered into with Exponent, on behalf of the City's Department of Public Utilities, Division of Electricity, to pay the final invoice for services related to an examination of facilities and circumstances surrounding a fatal accident on the Town Street Bridge.
 
The amount of this modification is Twenty-Three Thousand, One Hundred Forty Two Dollars and 57/100 ($23,142.57).

To authorize the City Attorney to modify an existing contract with Exponent for consulting services in connection with the Town Street Bridge, to authorize the expenditure of an additional Twenty Three Thousand, One Hundred Forty Two and 57/100 Dollars ($23,142.57), to waive the competitive bidding provisions of the Columbus City Codes, and to declare an emergency.
 
 
Body
WHEREAS,  the City Council, pursuant to Ordinance No. 0832-03, passed on June 2, 2003, did authorize the City Attorney to entered into an agreement for consulting services, on behalf of the City's Department of Public Utilities, Division of Electricity, with Exponent for Thirty Five Thousand Dollars ($35,000.00); and
 
WHEREAS,  the final invoice for consulting services exceeded the amount originally estimated; and
 
WHEREAS, an emergency exists in the usual daily operation of the City, and for the further preservation of the public peace, health , safety and welfare; now therefore,
 
BE  IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO:
 
Section 1.  That the City Attorney be, and he is hereby authorized to modify the existing Contract, No.  DL005603, with Exponent for consulting services by increasing the maximum contract obligation by Twenty Three Thousand One Hundred Forty Two and 57/100 Dollars ($23,142.57) for a total expenditure of Fifty Eight Thousand One Hundred Forty Two and 57/100 Dollars ($58,142,57) .  All other contract terms and conditions shall remain in full force and effect.  
 
Section 2.  That the provisions of Chapter 329 Columbus City Codes relative to the procurement of professional services are hereby waived, such waiver being deemed to be in the best interests of the City for the reason that this is a final payment on an existing contract that required specialized knowledge.
 
Section 3.  That there is hereby appropriated and authorized to be expended the additional sum of Twenty Three Thousand One Hundred Forty Two and 57/100 Dollars ($23,142.57) and the City Auditor is authorized and directed to draw warrants upon the treasury for services thereunder upon receipt of invoices approved by the Division of Electricity from:  Division 60-07, Fund No. 550, Object Level Three - 3336, OCA Code - 600700.
 
Section 4.  That for the reasons set forth in the preamble hereto, which is incorporated as if fully restated herein, this ordinance is deemed to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare, and by virtue whereof this ordinance shall take effect and be in force from and immediately after its passage and signature by the Mayor or within ten (10) days thereafter if the Mayor neither signs nor vetoes the same.
