Explanation
1. BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Kalkreuth Roofing and Sheet Metal Inc.in the amount of $73,025.00, for the HCWP Roof Restoration project, Division of Power and Water Contract Number 1178.
This project will furnish all materials, equipment, and labor necessary to provide for the removal of ballast and epdm membrane roof and installation of high performance roof system on the Sodium Hydroxide Building at the Hap Cremean Water Treatment Plant.  The HCWP Roof Restoration project will be performed in several phases with separate contracts.  Phase I was completed in 2011, the current project is the second phase.  A final project will complete the roof restoration on remaining portions of the pump and filter buildings and is scheduled for 2013.  The roof to be restored with this contract was damaged during the wind storm in June 2012.  Emergency legislation is being requested to take advantage of favorable weather conditions and before weather conditions are too cold for properly install the new roof restoration system.  
 
2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT:  
 
This project is necessary to repair the roof at Hap Cremean Water Plant (HCWP) which was damaged during the wind storm in June 2012.  This construction project will stop the water leakage into the area to be utilized as the Sodium Hydroxide Building as part of the Treatment Improvements (Ozone) project currently under construction at Hap Cremean Water Plant. The roof restoration will preserve the integrity of the existing building allowing it to be utilized to house the Sodium Hydroxide treatment process.   The HCWP is an essential and integral component in the Columbus area water supply and treatment infrastructure.  Adequate supply of water is essential to economic growth and development.  
There were no public meetings held regarding this work. The HCWP is a secure facility and is not a publically accessible building.    
The project specifications require that the roofing project utilize a modified bitumen membrane incorporating a combination of 28% post industrial and 11% pre consumer recycled content.  The roofing surface is specified to be supplied as a white, elastomeric, urethane coating with an Energy Star approval rating.
3. CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened two bids on August 22, 2012 from:  Re-Construction Industries- $63,223.55 and Kalkreuth Roofing and Sheet Metal Inc. - $73,025.00.
Kalkreuth Roofing and Sheet Metal Inc. was deemed the most responsive and responsible bidder in the amount of $73,025.00. Their Contract Compliance Number is 55-0647319 (expires 6/22/14, Majority).  The apparent low bidder at the time of the bid opening, Re-Construction Industries, had several irregularities in their bid including an insufficient bid bond, therefore their bid was deemed non-responsive. Furthermore Re-Construction Industries failed to complete a proposal affidavit. Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Kalkreuth Roofing and Sheet Metal Inc.
 
4. EMERGENCY DESIGNATION:  It is requested that this Ordinance be handled in an emergency manner as these improvements are of immediate concern due to the roof leakage at the HCWP as a result of the June 2012 wind storm.
 
5. FISCAL IMPACT:  This legislation includes a transfer of funds within the Water Build America  Bonds Fund (Fund 609) and an amendment to the 2012 Capital Improvements Budget.

WHEREAS, two bids for the HCWP Roof Restoration project were received and publicly opened in the offices of the Director of Public Utilities on August 22, 2012; and
WHEREAS, the most responsive and responsible bid was from Kalkreuth Roofing and Sheet Metal Inc. in the amount of $73,025.00; and
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract for the HCWP Roof Restoration project with Kalkreuth Roofing and Sheet Metal Inc.; and
 
WHEREAS, it is necessary for this Council to authorize the transfer and expenditure of funds within the Water Build America Bonds Fund, for the Division of Power and Water; and  
 
WHEREAS, it is necessary to authorize an amendment to the 2012 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Power and Water, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to enter into a construction contract with Kalkreuth Roofing and Sheet Metal Inc. for the HCWP Roof Restoration project, in an emergency manner in order to repair the leaking roof at the HCWP as a result of the June 2012 wind storm, for the immediate preservation of the public health, peace, property and safety; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to award and execute a construction contract for the HCWP Roof Restoration project with the most responsive, and responsible bidder, Kalkreuth Roofing and Sheet Metal Inc., Green Meadows Dr. North, Lewis Center, Ohio 43035; in the amount of $73,025.00; in accordance with the terms and conditions of the contract on file in the Office of the Division of Power and Water.
SECTION 2.  That the City Auditor is hereby authorized to transfer $73,025.00 within the Department of Public Utilities, Division of Power and Water, Water Build America Bonds Fund, Fund No. 609, Dept/Div. No. 60-09, Object Level Three 6623, as follows:

SECTION 4.  That the expenditure of $73,025.00 is hereby authorized for the HCWP Roof Restoration project within the Water Build America Bonds Fund, Fund No. 609, Dept.-Div. 60-09, Project No. 690500-100000, Object Level Three 6623, OCA Code 609500  
 
SECTION 5.  That said construction company shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power and Water.
SECTION 6.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 7.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
SECTION 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
