Explanation
Background: The City of Columbus is engaged in that project identified as the Evergreen/Dewberry Stormwater Improvement Project. The following is an ordinance to authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs in connection with the Evergreen/Dewberry Stormwater Improvement Project.
Fiscal Impact: The Department of Public Utilities, Division of Sewerage and Drainage determined that funding for this project will be from the Storm Sewer Bond Fund. This legislation includes a transfer of funds within the Storm Sewer Bonds Fund and an amendment to the 2007 Capital Improvements budget to allow sufficient cash and authority in the proper account for this project.
Emergency Justification: Emergency action is requested in order to provide for the immediate acquisition of real property interests within the time frame established by the Division of Sewerage and Drainage.

To authorize the City Attorney to acquire fee simple title and lesser interests, and to contract for professional services; to authorize the transfer of $10,300.00 within the Storm Sewer Bond Fund; to authorize an amendment to the 2007 Capital Improvements Budget; and to expend $10,300.00 from the Storm Sewer Bond Fund for costs in connection with the Evergreen/Dewberry Stormwater Improvement Project, and to declare an emergency. ($10,300.00).
Body
WHEREAS, the City of Columbus, The Department of Public Utilities, Division of Sewerage and Drainage is engaged in the Evergreen/Dewberry Stormwater Improvement Project; and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Storm Sewer Bond Fund; and
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage, in that it is immediately necessary to authorize the City Attorney to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the aforesaid professional services necessary in connection with said project for the immediate preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Evergreen/Dewberry Stormwater Improvement Project; and
Section 2. That the expenditure of $10,300.00, or so much thereof as may be necessary for the Evergreen/Dewberry Stormwater Improvement Project, Project #610775, from the Storm Sewer Bond Fund, Fund #685, OCA Code 685775, Object Level Three: 6601, for the appropriation of said real property interests determined to be necessary for the stated public purpose is hereby authorized.
Section 3. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
Section 4. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 6. That the City Auditor is hereby authorized to transfer $10,300.00 within the Storm Sewer Bonds Fund, Fund 685, Division of Sewerage and Drainage, Division 60-15, Object Level 3 6601 as follows:

Section 7. That the 2007 Capital Improvements Budget Ordinance No. 1108-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of the construction contract stated in Section 1 herein.

Section 8. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
