Explanation
 
This ordinance authorizes a modification to the Transportation Division's existing General Engineering contract with Burgess & Niple, Limited.  The scope of this contract provides for the design and production of construction plans for Longrifle Road traffic calming elements.  This modification is due to the necessity of integrating new City of Columbus design criteria into the design and plans as well as design changes that significantly alter the scope of the original contract and its amount.
Burgess & Niple, Limited, was selected in accordance with Columbus City Code Chapter 329 covering professional services contracts.  Contract EA012949-002 & 004 was authorized by Ordinance 1690-1999 passed July 12, 1999, executed July 28, 1999, and approved by the City Attorney August 3, 1999.  Existing hourly rates and projected times were used to negotiate the amount of this modification.  Burgess & Niple, Limited's contract compliance number is 31-0885550 and expires December 12, 2005.
 
The original contract amount was for $250,000.00.  This first modification totals $50,000.00.  The total contract amount including this modification is $300,000.00.
 
Fiscal Impact:  The Transportation Division budgeted $50,000 in the 2004 Capital Improvements Budget for traffic calming design on Longrifle Road.  This ordinance authorizes and expenditure of $50,000.00.  
 
Emergency action is requested so that the design contract can proceed in an expeditious manner in order to meet the proposed construction schedule, and promote and enhance motorist and pedestrian safety.

WHEREAS, Contract EA012949-002 & 004 was authorized by Ordinance 1690-1999 passed July 12, 1999, executed July 28, 1999, and approved by the City Attorney August 3, 1999; and
 
WHEREAS, it necessary to modify Contract EA012949-002 & 004 to increase the scope of services as per the consultant's letter dated October 3, 2003, for the Longrifle Road project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified immediately to provide for additional design for the Longrifle Road traffic calming project and to provide for the earliest possible completion of the design in order to meet the proposed construction schedule and promote and enhance motorist and pedestrian safety, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to modify and increase EA012949-002 & 004 with Burgess & Niple, Limited, 5085 Reed Road, Columbus, Ohio 43220 to complete the traffic calming design and construction plans for the Longrifle Road project in accordance with the plans on files in the office of the Public Service Director, which hereby approved.
 
SECTION 2.  That the sum of $50,000.00, or so much thereof as may be needed, is hereby authorized to be expended for this purpose from Fund 704, the 1995, 1999 Voted Street and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 590105.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
