Explanation
1. BACKGROUND
This legislation authorizes the Director of Public Utilities to modify the contract with Ameritcon, Inc., for the Southerly Wastewater Treatment Plant New Headworks, Primary Sludge Pumping Systems Improvements Project. This modification will provide funding for additional electrical equipment to control the hopper valves at the primary settling tanks, and the installation of new cables and conduit to existing grinders that have been relocated. This legislation will additionally authorize the appropriation, transfer, and expenditure of funds from the Sewerage System Reserve Fund to the Ohio Water Pollution Control Loan Fund for this contract modification.
2. FISCAL IMPACT:
This project work is being funded through the existing State of Ohio Water Pollution Control Loan Fund (WPCLF) loan CS392276-01, which is being administered by the Ohio Environmental Protection Agency and the Ohio Water Development Authority. There is sufficient budget authority within the 2004 Capital Improvements Budget for this expenditure.
3. CONSTRUCTION CONTRACT MODIFICATION:
This will be the final modification to this contract, whereupon the project will be successfully closed out. The amount requested under this ordinance is $52,577.00. The contract total including this modification is $ 1,679,027.00. Additional work to the contract work has been identified as necessary to provide a fully functional facility and will cost more than the contingency amount incorporated in the contract for such purposes. Due to the complex and comprehensive nature of this project, this additional work could not be foreseen, and it is not practical or feasible to undertake a new procurement to deliver these services.

WHEREAS, Contract No. EL002286, authorized April 15, 2002 by Ordinance No. 0608-02 , was executed with Ameritcon, Inc. to provide for the construction of the Southerly Wastewater Treatment Plant New Headworks, Primary Sludge Pumping System Improvements Project; and
WHEREAS, Division of Sewerage and Drainage engineering personnel have determined it necessary to modify the contract with Ameritcon, Inc., in order to provide for additional construction work that is necessary to ensure the successful completion of the project; and
WHEREAS, the Division of Sewerage and Drainage hereby requests this City Council to authorize the City Auditor to appropriate and transfer the required funds that are necessary to authorize the Director of Public Utilities to execute the aforementioned construction contract modification, at the earliest practicable date; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That from the unappropriated monies in the Sewerage System Reserve Fund No. 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2004 the sum of $52,577.00 is hereby appropriated to the Division of Sewerage and Drainage| Division 60-05| Object Level Three 5502| OCA Code 901654.
Section 2. That the City Auditor is hereby authorized and directed to transfer $52,577.00 to the Ohio Water Pollution Control Loan Fund No. 666, into the appropriate project accounts as specified within Section 3 herein, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
Section 3. That the expenditure of $52,577.00 is hereby appropriated within the Ohio Water Pollution Control Loan Fund No. 666| Project: Southerly Wastewater Treatment Plant New Headworks Project 650352| Division 60-05| OCA Code 651352| $52,577.00.
Section 4. That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewerage System Fund the amount transferred under Section 2, above, and said funds are hereby deemed appropriated for such purpose.
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modification associated with the expenditure of the funds transferred under Section 2, above.
Section 6. That the Director of Public Utilities be and hereby is, authorized to execute a construction contract modification in the amount of $52,577.00 with Ameritcon, Inc., 2589 Needmore Road, Dayton, Ohio 45414, for construction of the Southerly Wastewater Treatment Plants New Headworks Project, in order to provide for additional work as shown on the modification on file in the office of the Division of Sewerage and Drainage.
Section 7. That for the purpose of paying the cost of the construction contract modification, the expenditure of $52,577.00, or as much thereof as may be needed, is hereby authorized as follows from the Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Southerly WWTP New Headworks Proj. No. 650352| OCA Code 651352| Object Level Three 6624| $52,577.00.
Section 8. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
