Explanation
BACKGROUND:
Ordinance 1251-2021, passed on June 7, 2021, authorized the Director of the Department of Development to enter into a Housing Development Agreement (HDA) and Grant Agreement with MHP Sinclair Family Apartments, Inc. for the Sinclair Family Apartments project. Since passage of the ordinance, a request was made to update the vendor entering the HDA and Grant Agreement.
This legislation authorizes an amendment to Ordinance No. 1251-2021 to change vendor entering the HDA and Grant Agreement from “MHP Sinclair Family Apartments” to Columbus Metropolitan Housing Authority. The legislation must be amended to allow execution of the development agreement and grant agreement.
Emergency action is requested to support the approved emergency designation of Ordinance No. 1251-2021 in order to maintain project timelines.
Fiscal Impact: Funding is from the 2020 Capital Improvement Budget as amended by Ordinance 1251-2021.

Title
To amend Ordinance 1251-2021 to reflect a change in the vendor associated with the Housing Development Agreement (HDA) and Grant Agreement from MHP Sinclair Family Apartments to Columbus Metropolitan Housing Authority; and to declare an emergency.
Body
WHEREAS, Ordinance 1251-2021, passed June 7, 2021, authorized the Director of Development to enter into a Housing Development Agreement and Grant Agreement with MHP Sinclair Family Apartments, Inc. for the Sinclair Family Apartments project, a 180 unit affordable housing rental development; and
WHEREAS, prior to execution of the agreements, a request was made to change the name of the recipient from MHP Sinclair Family Apartments, Inc. to Columbus Metropolitan Housing Authority; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development to amend Ordinance 1251-2021 to maintain the project schedule, thereby preserving the public health, peace, property, safety and welfare; NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That Section 4 of Ordinance 1251-2021, passed June 7, 2021, be amended to read as follows: “That the Director of Development be and is hereby authorized to first enter into a Housing Development Agreement and then a Grant Agreement, in an amount up to $2,175,000.00 with Columbus Metropolitan Housing Authority, for the Sinclair Family Apartments project.”
Section 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
