Title: To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release a certain portion of a City owned easement, located in the vicinity of Greenlawn Avenue and Interstate 71, at the request of the Greenlawn Realty Co. in exchange for a replacement easement previously granted to the City of Columbus, Ohio.
Explanation
 
Background:    The City of Columbus, Ohio is the holder of certain sanitary sewer easement rights, located in the vicinity of Greenlawn Avenue and Interstate 71, by virtue of a recorded deed of easement.  Greenlawn Realty Co. has requested the City release a portion of its easement in exchange for a previously granted replacement easement.  After investigation, it has been determined that the proposed exchange of easements will not adversely affect the City and therefore should be granted.  The following legislation authorizes the Director of the Department of Public Utilities to execute those documents necessary to release a certain portion of the subject sewer easement in exchange for a previously granted replacement easement.

To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release a certain portion of a City owned easement, located in the vicinity of Greenlawn Avenue and Interstate 71, at the request of the Greenlawn Realty Co. in exchange for a replacement easement previously granted to the City of Columbus, Ohio.

WHEREAS,      the City of Columbus, Ohio is the holder of certain sanitary sewer easement rights, located in the vicinity of Greenlawn Avenue and Interstate 71, by virtue of a recorded deed of easement; and
 
WHEREAS,      Greenlawn Realty Co., has requested that the aforementioned sewer easement be released; and
 
WHEREAS,      the City has previously been granted a replacement easement for the subject development area; and
 
WHEREAS,      after investigation, the Division of Sewerage & Drainage has determined that the release of the subject easement will not adversely affect the operations of the City of Columbus and should be granted; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Director of the Department of Public Utilities be, and hereby is authorized to execute those documents, as prepared by the Department of Law, Real Estate Division, necessary to release the following described real property, to wit:
 
Description for Vacating 0.060 Acres
Of a 16' Sanitary Easement
Situated in the State of Ohio, County of Franklin, City of Columbus, V.M.S. 422 and being 0.060 Acres Vacating of an Existing 16' Sanitary Easement (Strip 2) crossing an Original 8.902 Acre Tract Conveyed to Greenlawn Realty Co. Deed Book 1720, Page 87, in the Franklin County Recorder's Office:
      Beginning for Reference at the Northeast Corner of said 8.902-Acre Tract, said Corner also being the Intersection of the Westerly Right-of-Way Line of Interstate 71 and the Southerly Right-of-Way Line of Greenlawn Avenue;
      Thence North 87º45'19" West following the Southerly Right of Way Line of Greenlawn Avenue and the Northerly Line of said 8.902 Acre Tract, a Distance of 285.15 feet to a Point;
      Thence South 01º59'09" West following an Existing 16' Sanitary Easement (Strip 1) and crossing the said 8.902 Acre Tract, a Distance of 115.25 feet to a Point, said Point being the True Point of Beginning;
      Thence South 01º59'09" West following an Existing 16' Sanitary Easement (Strip 1) and crossing the said 8.902 Acre-Tract, a Distance of 16.00 feet to a Point;
      Thence North 87º55'05" West following an Existing 16'Sanitary Easement (Strip 2) and crossing the said 8.902 Acre Tract, a distance of 164.69 feet to a Point;
      Thence North 02º14'41" East crossing an Existing 16' Sanitary Easement (Strip 2) and said 8.902 Acre Tract, a Distance of 16.00 feet to a Point;
      Thence South 87º55'05" East following an Existing 16'Sanitary Easement (Strip 2) and crossing the said 8.902 Acre Tract, a distance of 164.62 feet to the TRUE POINT OF BEGINNING, Containing 0.060 Acres more or less.
      Bearings were based on the Centerline of Greenlawn Avenue as being North 87º45'19" West as shown on the Right-of-Way Plans for Greenlawn Avenue-146 County Road.

      Section 2.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
