Explanation
 
Background:  Directions for Youth and Families, Inc., an Ohio non-profit corporation, ("Lessee"), desires to lease the City owned building located at 657 Ohio Avenue.  Directions for Youth and Families, Inc., intends to use the building to provide a community facility for counseling services, clinical services, and prevention and education programs for high-risk youth and families.  Under the proposed lease Directions for Youth and Families, Inc., will have an option to purchase the property at an agreed to amount, based on the appraised value.  The following legislation authorizes the Director of the Department of Finance and Management to execute those documents necessary to enter into a three (3) year lease agreement with Directions for Youth and Families, Inc.
 
Fiscal Impact:     Rental of the building will provide a revenue stream for the City of Columbus to offset the operation and maintenance expenses of this City owned facility.
 
Emergency Justification: Emergency action is requested to allow the execution of this agreement to proceed, thus allowing the ease to commence on December 1, 2005, without delay.

To authorize the Director of the Department of Finance and Management to enter into a three (3) year lease agreement with Directions for Youth and Families, Inc., an Ohio non-profit corporation, for the lease of City owned real property located at 657 Ohio Avenue, including an option to purchase, to waive the competitive bidding provisions of Chapter 329 of the Columbus City Codes with respect to the option to purchase, and to the extent they may be applicable, to waive the competitive bidding and Land Review Commission requirements of the Columbus City Codes (1959) Revised, and to declare an emergency.
 
Body
 
WHEREAS,      Directions for Youth and Families, Inc., a Ohio non-profit corporation desires to enter into a lease agreement with, the City for the City owned real property located at 657 Ohio Avenue; and
 
WHEREAS,      Directions for Youth and Families, Inc proposes to use the building for a community counseling and clinical services facility; and
 
WHEREAS,      under the lease, the Directions for Youth and Families, Inc., will have the option to purchase the property at an agreed to price based on its appraised value as stated; and
 
WHEREAS,      the following legislation authorizes the Director of the Department of Finance and Management to execute those documents necessary to enter into a three (3) year lease agreement; and
 
WHEREAS,      monthly rent shall be $3,688.27; and
 
WHEREAS,      an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of the Department of Finance and Management to execute those documents necessary to enter into a three (3) year lease agreement for the lease of the City owned real property located at 657 Ohio Avenue for the immediate preservation of the public health, peace, property and safety; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Director of the Department of Finance and Management be, and hereby is, authorized to execute those documents approved by the Department of Law, Division of Real Estate necessary to enter into a lease agreement with Directions for Youth and Families, Inc., a Ohio non-profit corporation, ("Lessee"), for the lease that City owned real property located at 657 Ohio Avenue.
 
      Section 2.      That the lease shall be in form approved by the City Attorneys Office and shall include the following:
 
a)      The annual rent shall be $44,259.20.0
 
b)      The "Lessee" will have the option to purchase the subject real property within the second and third term of the agreement at an agreed to price based on its appraised value.
 
      Section 3.      That this Council has determined that it is in the best interest of the City of Columbus to waive and does hereby waive the requirements of Columbus City Codes (1959) Revised, Chapter 328 (Land Review Commission) and Section 329.29 (competitive bidding) to the extent that they may apply to this transaction with regards to this ordinance only.
 
      Section 4.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
