Explanation

 

1.  BACKGROUND:  This construction project will renew aging public sewer infrastructure and clear the way for redevelopment of a site on Broad Street in the East Franklinton area.  The installation of 50 feet of 8” sanitary pipe, 527 feet of 15” sanitary pipe, cured in place pipe rehabilitation of 457 feet of 30” pipe and other such work as may be necessary.  This project is one component of a larger project, East Franklinton Gravity 2.0 Pedestrian Improvements, a collaborative effort between the Departments of Development, Service and Utilities.

2.  THE PROJECT TIMELINE: Contract work is required to be completed in a manner acceptable to the City within 120 days from the date that a Notice To Proceed (NTP) is given by the City.

3.  PROCUREMENT:   In accordance with the procedures set forth in the overall provisions of Columbus City Code, Section 329, Invitation for Bids were received July 22, 2020.  Six (6) competitive bids were received. The following bidders submitted bids:

The selection process used the Bid Tab and Quality Factor Form evaluation process and the project was awarded to the lowest responsive, responsible and best bidder, Danbert, Inc.

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Danbert, Inc.

 

4. EMERGENCY DESIGNATION:  This Ordinance is being requested as an Emergency ordinance in order to meet project timelines and deliverables.

 

5.  ECONOMIC/ENVIRONMENTAL IMPACT:  The project will aid in preparing a key downtown site for redevelopment.  Replacement of aging sewer infrastructure will reduce groundwater inflow into the sewer system and help reduce sewer overflows to the Scioto River.

 

6.  FISCAL IMPACT: This project is being performed in support of a larger project, East Franklinton Gravity 2.0 Pedestrian Improvements, with the Department of Development and the Department of Public Service.  This contract will transfer within and expend up to $381,209.15 from the Streets & Highways General Obligation Bond Fund 7704, which is inclusive of $346,553.77 for the construction contract with Danbert, Inc. and up to $34,655.38 for the construction administration and inspections services with the Department of Public Services.  An amendment to the 2019 Capital Improvement Budget to align authority.

 

 

Title

 

To authorize the Director of Public Utilities to enter into a construction contract with Danbert, Inc. for the Sanitary Sewer Improvements - State & McDowell; to authorize the transfer within and expenditure of up to $346,553.77 within the Streets & Highways General Obligation Bond Fund; to authorize the transfer within and expenditure of up to $34,655.38 for Construction Administration and Inspection Services to the Department of Public Service; to amend the 2019 Capital Improvement Budget; and to declare an emergency. ($381,209.15)

 

Body

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to execute a construction contract with Danbert, Inc. for the Division of Sewerage and Drainage’s Sanitary Sewer Improvements - State & McDowell Project which is part of a larger project with other city departments for the East Franklinton Gravity 2.0 Pedestrian Improvements; and

 

WHEREAS, it is necessary to authorize the transfer within and expenditure of up to $346,553.77 from the Streets and Highways General Obligation Bond Fund 7704 with Danbert, Inc. for the construction of the Sanitary Sewer Improvements - State & McDowell Project, CIP# 440104-100036; and

 

WHEREAS, it is necessary to authorize the transfer within and expenditure of up to $34,655.38 from the Streets and Highways General Obligation Bond Fund 7704 for Construction Administration and Inspections Services from the Department of Public Service; and

 

WHEREAS, it is necessary to amend the 2019 Capital Improvement Budget in order to align the authority for these expenditures; and

 

WHEREAS, an emergency exists in the usual daily operations of the Department of Public Utilities in that it is immediately necessary to authorize the Director to enter into a construction contract with Danbert, Inc. for the Sanitary Sewer Improvements - State & McDowell Project in order to meet project timelines and deliverables, for the preservation of the public health, peace, property, and safety; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities is hereby authorized to enter into a construction contract with Danbert, Inc., 8077 Memorial Drive, Plain City, OH 43064; for the Sanitary Sewer Improvements - State & McDowell Project in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage; and to obtain the necessary construction administration and inspection services from the Department of Public Services.

 

SECTION 2.  That the transfer within and expenditure of up to $346,553.77 from the Streets & Highways General Obligation Bond Fund 7704 is authorized per the accounting codes attached to this ordinance for the construction services with Danbert, Inc. 

 

SECTION 3.  That the transfer within and expenditure of up to $34,655.38 from the Streets & Highways General Obligation Bond Fund 7704 is authorized per the accounting codes attached to this ordinance for the construction administration and inspection services with the Department of Public Service. 

 

SECTION 4.  That the 2019 Capital Improvement Budget is amended as follows:

SECTION 5.  That the said company, Danbert, Inc., shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.

 

SECTION 6.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.

 

SECTION 7.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 8.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 9.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 10.  That for the reasons stated in the preamble hereto, which is made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes this Ordinance.
