Title: To authorize the Director of the Public Service Department to execute those documents necessary to allow the City to grant a 0.001-acre encroachment easement into the south side of Grove Street to Columbus State Community College.
Explanation
 
The Public Service Department, Transportation Division, recently received a request from Columbus State Community College ("Columbus State"), asking that the City grant a 0.001-acre encroachment easement into the south side of Grove Street beginning 178.44 feet west of the west line of Cleveland Avenue.  This easement is needed to allow Columbus State to construct step at the entrance to a new building at 395 Grove Street and still preserve the existing ADA compliant grade along Grove Street.  Per current Transportation Division practice, comments were solicited from interested parties, including City departments and private utilities before it was determined that there would be no adverse impact to the City upon the granting of this easement.  The Public Service Department, Transportation Division is recommending this easement be granted to Columbus State at no charge in recognition of the proposed donation of a 0.011 acre tract of additional right-of-way along the west side of Cleveland Avenue, north of Mt. Vernon Avenue, to the City from Columbus State.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from Columbus State Community College ("Columbus State"), asking that the City grant a 0.001 acre encroachment easement into the south side of Grove Street 178.44 feet west of the west line of Cleveland Avenue; and
 
WHEREAS, this easement is needed to allow Columbus State to construct step at the entrance to a new building at 395 Grove Street and still preserve the existing ADA compliant grade along Grove Street; and
 
WHEREAS, per current Transportation Division practice, comments were solicited from interested parties, including City departments and private utilities before it was determined there would be no adverse impact to the City upon the granting of this easement; and

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to allow the City to grant the following described encroachment easement to Columbus State Community College; to-wit:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Section 11, Township 5, Range 22, Refugee Lands, being on, over and across a portion of Grove Street (all references refer to the records of the Recorder's Office, Franklin County, Ohio) being more particularly described as follows:
Beginning for Reference at the centerline intersection of Grove Street and Cleveland Avenue;
Thence North 86°52'40" West, a distance of 211.44 feet, with the centerline of said Grove Street, to a point;
Thence South 03°13'01" West, a distance of 28.00 feet, across said Grove Street, to the TRUE POINT OF BEGINNING;
Thence South 03°13'01" West, a distance of 2.00 feet, continuing across said Grove Street, to a point in the southerly right-of-way line thereof;
Thence North 86°52'40" West, a distance of 31.00 feet, with said southerly right-of-way line, to a point;
Thence across said Grove Street the following courses and distances:
North 03°13'01" East, a distance of 2.00 feet, to a point;
South 86°52'40" East, a distance of 31.00 feet, to the TRUE POINT OF BEGINNING.  Containing 0.001 acre, more or less.
