Explanation

 

Background:  This legislation authorizes an amendment to Ord. 0265-2026, passed by Columbus City Council on February 23, 2026, to authorize the Director of Finance and Management, on behalf of Facilities Management Division, to enter into a contract with The Waterworks, LLC., to waive the competitive bidding provisions of the Columbus City Codes and to declare an emergency.

An amendment to Ord. 0265-2026 is necessary due to a bid waiver being required in order to enter into a separate contract with The Waterworks LLC, since the past and current UTCs for plumbing services with The Waterworks LLC. has a contractual threshold which does not satisfy the quoted dollar amount needed for the plumbing system replacement. Thus, the UTC will not be used and instead a separate contract will be entered into for this project.

Emergency action: Emergency action is requested as noted in ordinance 0265-2026. 

Fiscal Impact: This legislation amends Ord. 0265-2026 with no fiscal impact.

 

Title

 

To amend Ord. 0265-2026 to authorize the Director of Finance and Management, on behalf of Facilities Management Division, to enter into a separate contract with The Waterworks LLC; to waive the competitive bidding provisions of the Columbus City Codes; and to declare an emergency. ($0.00)

 

Body

 

WHEREAS, Columbus City Council previously approved Ord. 0265-2026 on February 23, 2026, authorizing the Director of Finance and Management to enter into a contract with The Waterworks, LLC., for a plumbing replacement system at Police Substation 13, located at 544 E. Woodrow Ave.

WHEREAS, it is in the best interest of the City to waive the competitive bidding provisions of City Code Chapter 329; and

WHEREAS, no funding is required for this amendment; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Finance Management, on behalf of Facilities Management Division, it is immediately necessary to effectuate this amendment for the immediate preservation of the public health, peace, property, welfare and safety; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.   That section 1 of Ordinance 0265-2026 is hereby amended as to read as follows with added language underlined:

                     SECTION 1. That the Director of Finance and Management, on behalf of the Facilities Management Division, is hereby authorized to enter into a separate contract with The Waterworks LLC. since the requested dollar amount of the plumbing replacement project exceeds the past and current UTC thresholds for the plumbing replacement, in an amount up to $93,415.00.

SECTION 2.  That the background of Ordinance No 0265-2026 is hereby amended to read as follows with deleted language struck-through:

                     BACKGROUND: This legislation authorizes the Director of Finance and Management, on behalf of the Facilities Management Division, to establish a contract from the current UTC with The Waterworks, LLC., to replace the plumbing system, within Police Substation 13, and to declare an emergency.The scope of this project includes the removal and replacement of the plumbing system located at 544 E. Woodrow Ave, Police Substation 13, to the men’s restroom and basement areas and any other such work as deemed necessary.

SECTION 3. That the current BACKGROUND and SECTION 1 of Ord. 0265-2026 are hereby repealed.

SECTION 4. That this Council finds it to be in the best interest of the City to waive the relevant provisions of Chapter 329 of the Columbus City Codes relating to competitive bidding for this contract and does hereby waive the same.

SECTION 5. That all other provisions of Ord. 0265-2026 shall remain in full force and effect.

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
