Explanation
1. BACKGROUND
The City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel Road Project. The project limits are Fairwood Avenue from Watkins Road to just north of Koebel Road, including alleys and side roads.
This project will lower the existing roadway profile to provide for positive drainage and full depth pavement replacement. Also included with this project are the installation of concrete curb and gutter, a new storm sewer system, pavement markings, signing, ADA compliant sidewalks and curb ramps.
As part of this project 24 ADA curb ramps and 1.12 miles of sidewalk and curb and gutter will be added or reconstructed.
The construction plans have been finalized and the Department of Public Service is prepared to authorize right-of-way acquisition pending passage of this funding legislation. Acquisition related expenses are currently estimated to be $250,000.00.
2. Fiscal Impact
Monies to pay for these costs are available due to cancellations of encumbrances from completed projects within the Build America Bonds Fund.
3. Emergency Justification
The roadway, pedestrian and stormwater improvements contemplated by this project are essential to the safety of those individuals living and traveling within this area. Failure to complete right-of-way acquisition in a timely manner will delay the construction if this arterial street rehabilitation project. Emergency action is requested to allow right-of-way acquisition to begin as soon as possible.

To authorize the City Attorney's Real Estate Division to contract for professional services relative to the acquisition of fee simple title and lesser interests in and to property needed for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel Road Project; to authorize the City Attorney's Office, Real Estate Division, to negotiate with property owners and to acquire the additional rights-of-way necessary to complete this project; to amend the 2011 C.I.B.; to authorize the transfer of funds within the Build America Bonds Fund; to authorize the expenditure of $250,000.00 or so much thereof as may be necessary to acquire the rights-of-way needed for this project from the Build America Bonds Fund and to declare an emergency. WHEREAS, the City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel Road Project; and
WHEREAS, the project limits are Fairwood Avenue from Watkins Road to just north of Koebel Road, including alleys and side roads; and
WHEREAS, the purpose of this project is to lower the existing roadway profile to provide for positive drainage and full depth pavement replacement; install concrete curb and gutter, a new storm sewer system, pavement markings, signing, ADA compliant sidewalks and curb ramps; and
WHEREAS, the roadway, pedestrian and stormwater improvements contemplated by this project are essential to the safety of those individuals living and traveling within this area; and
WHEREAS, construction plans have been finalized and the Department of Public Service is prepared to authorize right-of-way acquisition pending passage of this funding legislation; and
WHEREAS, acquisition related expenses are currently estimated to be $250,000.00; and
WHEREAS, the following legislation authorizes the City Attorney's Real Estate Division to expend $240,000.00 or so much thereof as may be necessary to acquire those rights-of-way needed for this project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction in that failure to complete right-of-way acquisition in a timely manner will delay the construction of this arterial street rehabilitation project therefore it is immediately necessary to authorize City Attorney's office to acquire those rights-of-way needed for this project and to authorize the expenditure of the funds required to complete right-of-way acquisition thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Attorneys' Office, Real Estate Division, be and is hereby authorized to acquire fee simple title and lesser interests in and to property needed for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel Road Project.
SECTION 2. That the 2011 Capital Improvement Budget authorized by ordinance 0266-2011 be and is hereby amended to provide sufficient authority for this project as follows:

SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
