Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to execute a contract with Kokosing Construction Company, Inc., for the construction of the Piedmont/High Area Sanitary Improvements Project and the Orchard/Milton Area Sanitary Improvements Project.   These projects will rehabilitate approximately 17,900 lineal feet of eight to 18-inch diameter sanitary sewer lines serving homes within the project areas that are located in the Clintonville Community.  This project also includes Voted Storm Bond Funds for the stormwater infrastructure improvement costs that were deemed inelgible by the Ohio Water Development Authority, and which are a part of this contract work.  
 
This contract will utilize trenchless technology methods to minimize the disruption to residences in the project area and to avoid the costlier method of traditional open trench sewer removal and replacement.
 
The Director of Public Utilities publicly opened four competitive bid proposals on August 31, 2005.  The cumulative results of these bids were: Kokosing Construction Company, Inc. submitted a bid of $1,286,069.90; and InsituformTech, Inc. submitted a bid of $1,354,500.96; Reynolds Inliner, LLC submitted a bid of $1,523,619.24; and American Water Services, Inc. submitted a bid of $1,575,642.30.  The Engineer's Estimate for this project was $1,783,387.80.  In order to fund this contract, it was necessary to wait until an OWDA Loan could be requested, approved and executed by the Ohio Water Development Authority.  The OWDA Board approved this loan on October 27, 2005.  
 
2.  FISCAL IMPACT:  This legislation appropriates a total of $1,427,793.35 from the OWDA Loan that will be utilized for the subject project.  $1,246,169.90 is for the cost of construction services.  The remaining $181,623.45 (Obj. Level 3 Requests) is for the cost of construction administration and inspection services that will be requested within a separate professional engineering services contract award with RD Zande & Associates, Inc.
 
3.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is requesting City Council to consider this legislation an emergency measure in order to allow for the immediate commencement of this contract work that is necessary to rehabilitate nearly 17,915 lineal feet of sanitary sewer serving a residential area in the Clintonville community, pursuant to ensuring the continued operation of this vital sanitary sewer infrastructure.

Body
WHEREAS, four competitive bids for the construction of the Piedmont/High Area Sanitary Improvements Project and the Orchard/Milton Area Sanitary Improvements Project were received on August 31, 2005, and
 
WHEREAS, the Ohio Water Development Authority approved a loan to the City of Columbus on October 27, 2005, in the amount of $1,900,763.00, identified as OWDA Loan No. 4394, for the above listed projects with eligible costs including the construction contract; the construction administration services contract; and the original professional engineering design services contract; and capitalized interest; and
 
WHEREAS, Voted Storm Bond Funds are required to provide funding for ancillary storm sewer improvements that were deemed inelgible under the terms of the OWDA Loan Agreement; and
 
WHEREAS, it is immediately necessary for the City Council to both appropriate the proceeds from the aforementioned loan agreement and to authorize the expenditure of funds from the Ohio Water Pollution Control Loan Fund and the Voted Storm Bond Fund; and now, therefore
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, in that it is necessary for this City Council to authorize the Director of Public Utilities to execute a contract for the construction of the Piedmont/High Area Sanitary Improvements Project and the Orchard/Milton Area Sanitary Improvements Project; to appropriate and authorize the expenditure of the proceeds from the aforementioned loan, and the Voted Storm Bond Fund; all of which is necessary to allow for the immediate rehabilitation of this aging and structurally deficient sanitary and storm sewer infrastructure, for the preservation of the public health, peace, property, and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the proceeds from the Ohio Water Development Authority Loan No. 4394, for the Piedmont/High Area Sanitary Improvements Project and the Orchard/Milton Area Sanitary Improvements Project; and funds from the unappropriated monies in Fund 666, the amount of $1,427,793.35 for the cost of construction and construction administration services, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, Fund No. 666:

Section 2.  That the City Auditor is hereby authorized to transfer $39,900.00 within the Storm Sewer Bond Fund, Fund No. 685, Division of Sewerage and Drainage, Division 60-15, as follows:

Section 3.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
 
Section 4.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the Piedmont/High Area Sanitary Improvements Project and the Orchard/Milton Area Sanitary  Improvements Project with the lowest, and best bidder, Kokosing Construction Company, Inc., 886 McKinley Ave., Columbus, Ohio 43222, in the amount of $1,286,069.60, in accordance with the terms and conditions of the Contract on file in the Sewer System Engineering Section Office of the Division of Sewerage and Drainage.
 
Section 5.  That for the purpose of paying the cost of construction contract, the expenditure of $1,286,069.90 or as much thereof as may be needed, is hereby authorized from the Ohio Water Pollution Control Loan Fund and the Voted Storm Bond Fund as follows:

Section 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
