Explanation

 

1.                     Background

The City of Columbus, Department of Public Service, received a request from Thornwood Commons Homes, LLC, asking that the City allow two dumpster enclosures to remain within the public right-of-way. One along the east side and one along the west side of Fassett Avenue, south of Leona Avenue. This project is a renovation of 86 affordable rental apartments at 1084 and 1110 Olmstead Avenue and these encroachments are located within easements as described below and within the attached exhibit.

 

The following legislation authorizes the Interim Director of the Department of Public Service to execute those documents necessary for the City to grant these encroachments to legally allow these items to remain within the public rights-of-way. Allowing these elements to remain will maintain trash pickup and serve the Thornwood Commons apartments and meet the City’s requirements for trash service. A value of $500.00 for these encroachment easements was established.

 

2.                     Fiscal Impact

The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachments.

WHEREAS, the City of Columbus, Department of Public Service, received a request from Thornwood Commons Homes, LLC, asking that the City allow two dumpster enclosures to remain within the public right-of-way. One along the east side and one along the west side of Fassett Avenue, south of Leona Avenue; and

 

WHEREAS, this project is a renovation of 86 affordable rental apartments at 1084 and 1110 Olmstead Avenue and these encroachments are located within easements as described below and within the attached exhibit; and

 

WHEREAS, the following legislation authorizes the Interim Director of the Department of Public Service to execute those documents necessary for the City to grant these encroachments to legally allow these items to remain within the public rights-of-way. Allowing these elements to remain will maintain trash pickup and serve the Thornwood Commons apartments and meet the City’s requirements for trash service; and

 

WHEREAS, a value of $500.00 for the encroachment easement was established; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  Authorizes the Interim Director of the Department of Public Service to execute those documents necessary for the City to grant these encroachments to legally allow these items to remain within the public rights-of-way. Allowing these elements to remain will maintain trash pickup and serve the Thornwood Commons apartments and meet the City’s requirements for trash service; to-wit:

 

 

DUMPSTER ENCLOSURE EASEMENTS

EAST SIDE OF FASSETT AVENUE

 

Situate in Quarter Township 4, Township 1 North, Range 18 West, U.S. Military Lands, City of Columbus, Franklin County, Ohio and being part of Fassett Avenue, a 50’ wide public street and being more particularly described as follows:

Commencing at the northwest corner of Lot 140 of Theodore Weyant’s Subdivision of Reserve “A” of Elias F. Shoemaker’s Addition to the City of Columbus as recorded in P.B. 7 Page 194 of the Franklin County Recorder’s Office;

Thence along the east right-of-way line of Fassett Avenue, S04°04’57”W a distance of 117.56 feet to the True Point of Beginning;

Thence continuing along said right-of-way line, S04°04’57”W a distance of 25.45 feet;

Thence along lines through said Fassett Avenue the following three courses:

1.)                     N86°37’17”W a distance of 12.06 feet;

2.)                     N04°04’57”E a distance of 25.45 feet;

3.)                     S86°37’17”E a distance of 12.06 feet to the Point of Beginning.

The above described area containing 0.007 acres more or less and being subject to easements and restrictions of record.The above description was prepared by The Kleingers Group, Inc., under the direction of David L. Cox, Ohio Professional Surveyor No. 7101.

 

WEST SIDE OF FASSETT AVENUE

 

Situate in Quarter Township 4, Township 1 North, Range 18 West, U.S. Military Lands, City of Columbus, Franklin County, Ohio and being part of Fassett Avenue, a 50’ wide public street and being more particularly described as follows:

Commencing at the northeast corner of Lot 141 of Theodore Weyant’s Subdivision of Reserve “A” of Elias F. Shoemaker’s Addition to the City of Columbus as recorded in P.B. 7 Page 194 of the Franklin County Recorder’s Office;

Thence along the west right-of-way line of Fassett Avenue, S04°04’57”W a distance of 117.24 feet to the True Point of Beginning;

Thence along lines through said Fassett Avenue the following three courses:

1.)                     S85°55’03”E a distance of 12.58 feet;

2.)                     S04°04’57”W a distance of 25.32 feet;

3.)                     N85°55’03”W a distance of 12.58 feet to a point in the west right-of-way line of Fassett Avenue;

Thence along said right-of-way line, N04°04’57”E a distance of 25.32 feet to the Point of Beginning, containing 0.007 acres more or less and being subject to easements and restrictions of record.

SECTION 2.  That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the director of the Department of Public Service executing and acknowledging any of those instrument(s). 

 

SECTION 3. That the City will receive a total of $500.00 to be deposited in Fund 7748, Project P537650, for granting the requested easement.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
