Explanation
 
The Public Service Department, Transportation Division, is engaged in the improvement of Hard Road between Sawmill Road and State Route 315.  The roadway will be widened from two to five lanes and incorporate a grade separation (bridge) at intersecting railroad tracks, curbs, sidewalks and storm sewers to accommodate increased traffic and promote pedestrian safety.  There are three schools adjacent to the project:  Granby Elementary, McCord Middle, and Worthington Kilbourne High.  The project has been divided into three phases ("A", "B," and "C").  Phase A is Sawmill Road to Smokey Row Road, Phase B is Smokey Row Road to Linworth Road and Phase C is Linworth Road to State Route 315.  Hard Road Phase B is currently under construction.  Phase C is under design and will be constructed in 2006.
 
The city entered into a contract for $698,200.00 for the design of Phase B with URS Corporation (aka URS Greiner, Inc.) on May 12, 1998 as authorized by Ordinance #0950-1998 passed April 6, 1998 (Contract CT-19317).  This contract was modified and increased by $755,712.00 on May 31, 2001, as authorized by Ordinance #0812-2001, passed May 4, 2001 to include the design of Phase C.    
 
This legislation authorizes Modification No. 2 for $250,000.00.  This modification provides for additional traffic studies, additional pavement design, updates to new city specifications, revisions to new city standards for Americans with Disabilities Act (ADA)-compliant wheel chair ramps, and other design changes.
 
Including Modification No. 2, the design contract authorization totals $1,703,912.00.  URS Corporation's contract compliance number is 94-1716908 and expires January 3, 2005.
 
Fiscal Impact:  The Transportation Division budgeted $450,000.00 for Hard Road Phase B in the 2004 Capital Improvements Budget under the Federal/State Match project.  This ordinance authorizes and expenditure of $250,000.00.  This ordinance also transfers/appropriates these monies to the Federal State Highway Engineering Fund, where they are ultimately expended.

WHEREAS, contract number CT-19317 for design services for the widening of Hard Road between Smoky Row Road and State Route 315 was authorized by Ordinance 0950-1998 passed April 6, 1998; and
 
WHEREAS, contract number CT-19317 for the design of Hard Road Phase C and other supplemental services was modified by Ordinance 0812-2001, passed May 4, 2001; and
 
WHEREAS, the Mid-Ohio Regional Planning Commission has identified funding for Hard Road Phase C right-of-way acquisition in State Fiscal Year 2004 and construction in State Fiscal Year 2006; and
 
WHEREAS, it is necessary to modify and increase this contract to provide for additional traffic studies, additional pavement design, updates to new city specifications, revisions to new city standards for ADA-compliant wheel chair ramps and other changes, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the transfer of $250,000.00 within Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, be and hereby is authorized as follows:

SECTION 3.   That the sum of $250,000.00 be and hereby is appropriated from the unappropriated balance of Fund 765, the Federal State Highway Engineering Fund, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2004, to Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6681, OCA Code 561001 and Grant 561001.
 
SECTION 4.   That the monies appropriated in the foregoing Section 3 shall be paid upon order of the Public Service Director and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
SECTION 5.  That the Public Service Director be and hereby is authorized to modify and increase contract number CT 19317 with URS Corporation, 277 West Nationwide Boulevard, Columbus, Ohio 43215-2566 by $250,000.00 for additional traffic studies, additional pavement design, updates to new city specifications, revision to new city standards for Americans with Disabilities Act (ADA)-compliant wheel chair ramps and other changes.
 
SECTION 6.  That the sum of $250,000.00, or so much thereof as may be needed, is hereby authorized to be expended from the 1995, 1999 Voted Streets and Highways Fund, Fund 765, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6681, OCA Code 561001 and Grant 561001.
 
SECTION 7.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
