SOUTH LINDEN AREA COMMISSION RECOMMENDATION: Approval.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The applicant has received a recommendation of approval from Staff and the Development Commission for a concurrent rezoning (Ordinance #3047-2024; Z24-033) from the C-3, Commercial District to the R-4, Residential District. The proposed development will allow single- and two-unit dwellings, and variances to required parking and side yard requirements are necessary. The proposed variances and the site plan included with the request reflect a development that is consistent with the recommendations of the Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018), which states that new housing construction should be consistent with surrounding densities and building types in the neighborhood.

To grant a Variance from the provisions of Sections 3312.49, Required parking; 3332.25(B), Maximum side yard permitted; and 3332.26(C)(3), Minimum side yard permitted, of the Columbus City Codes; for the property located at 1661 E. HUDSON ST. (43211), to allow reduced development standards for single- and two-unit dwellings in the R-4, Residential District (Council Variance #CV24-090).

WHEREAS, by application #CV24-090, the owner of property at 1661 E. HUDSON ST. (43211), requests a Council variance to allow reduced development standards for single- and two-unit dwellings in the R-4, Residential District; and
WHEREAS, Section 3312.49, Required parking, requires two parking spaces per dwelling unit, or 18 total spaces for one single-unit dwelling and four two-unit dwellings, while the applicant proposes a reduced total of nine parking spaces, with one space provided per dwelling unit, as shown on the submitted site plan; and
WHEREAS, Section 3332.25(B), Maximum side yard permitted, requires the sum of the widths of the side yards to equal or exceed 20 percent of the width of the lot, a maximum requirement of 9.4± feet for a lot width of 47 feet, while the applicant proposes a reduced maximum side yard of 8.25± feet for the single-unit dwelling; and
WHEREAS, Section 3332.26(C)(3), Minimum side yard permitted, requires that the minimum side yard be no less than five feet, while the applicant proposes reduced side yards of 4.5± feet along the eastern and western property lines for all of the two-unit dwellings; and
WHEREAS, the South Linden Area Commission recommends approval; and
WHEREAS, the City Departments recommend approval because the request is generally consistent with C2P2 Design Guidelines for residential infill developments in this area, in that the proposed development is of character with the surrounding densities and building types in the neighborhood.
WHEREAS, this ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed dwellings; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 1661 E. HUDSON ST. (43211), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That a variance from the provisions of Sections 3312.49, Required parking; 3332.25(B), Maximum side yard permitted; and 3332.26(C)(3), Minimum side yard permitted, of the Columbus City Codes, is hereby granted for the property located at 1661 E. HUDSON ST. (43211), insofar as said sections prohibit reduced required parking from 18 total spaces for nine dwelling units to nine spaces; reduced maximum side yard from 9.4± to 8.25± feet for the single-unit dwelling; and a reduced minimum side yard from five to 4.5 feet on the eastern and western property lines for all of the two-unit dwellings; said being more particularly described as follows:

Being Lots Numbered Three Hundred Eighty-Three (383), Three Hundred Eighty- Four (384), Three Hundred Eighty-Five (385), and Three Hundred Eighty-Six (386) of Innis Crest, as the same are numbered and delineated upon the recorded plat thereof, of record in Plat Book 8, Page 15B, Recorder's Office, Franklin County, Ohio.

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for those uses permitted in the R-4, Residential District.
SECTION 3. That this ordinance is further conditioned on the subject site being developed in general conformance with the plans titled “ARCHITECTURAL SITE PLAN” and “EXTERIOR ELEVATIONS SHEETS 1-9,” all dated October 30, 2024, and signed by Maria Anderson, Architect for the Applicant. The plans may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plans shall be subject to review and approval by the Director of the Department of Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.
SECTION 4. That this ordinance is further conditioned on the applicant obtaining all applicable permits and Certificate of Occupancy for the proposed dwellings.
SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
