Council Variance Application: CV25-057

 

APPLICANT:  Jonathan Romanovich; 2833 Oak Forest Drive; Grove City, OH 43123.

 

PROPOSED USE:  Residential development.

 

SOUTHWEST AREA COMMISSION RECOMMENDATION:  Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site consists of one parcel developed with two single-unit dwellings in the R, Rural District. A lot split has been proposed that will result in three new lots (Lot 001, Lot 002, and Lot 003). The requested Council Variance will allow a two-unit dwelling on Lot 001 and Lot 002, and will conform the development standards for the retained single-unit dwelling on Lot 003. A Council variance is required because the R district only allows single-unit dwellings as a primary residential land use. Variances to lot area, building lines, rear yard, and side yard obstruction are also included in this request. The request is consistent with the Southwest Area Plan’s (2009) land use recommendation ofLow Density Residential” and Columbus Citywide Planning Policies (C2P2) Design Guidelines as the project includes a high-level of site and architectural design and is compatible with the surrounding residential development.

 

 

Title

 

To grant a Variance from the provisions of Sections 3332.02, R-rural district; 3332.06, R-rural area district requirements; 3332.21(B), Building lines; 3332.27, Rear yard; and 3332.28, Side or rear yard obstruction, of the Columbus City Codes; for the property located at 1855 TANIS DR. (43123), to allow residential development with reduced development standards in the R, Rural District (Council Variance #CV25-057).

 

Body

 

WHEREAS, by application #CV25-057, the owner of the property at 1855 TANIS DR. (43123), is requesting a Council variance to allow residential development with reduced development standards in the R, Rural District; and

 

WHEREAS, Section 3332.02, R-rural district, allows one single-unit dwelling on a lot, while the applicant proposes a two-unit dwelling on Lot 001 and Lot 002; and

 

WHEREAS, Section 3332.06, R-rural area district requirements, requires that a principal building shall be situated on a lot of no less than five acres, while the applicant proposes reduced lot areas of 0.18 acres, 0.11 acres and 0.18 acres for Lot 001, Lot 002, and Lot 003, respectively; and

 

WHEREAS, Section 3332.21(B), Building lines, requires a minimum building setback line of 25 feet from Tanis Drive, while the applicant proposes reduced building lines of 21 feet for each proposed two-unit dwelling on Lot 001 and Lot 002; and

 

WHEREAS, 3332.27, Rear yard, requires each dwelling, residence or principal building shall be erected so as to provide a rear yard totaling no less than 25 percent of the total lot area, while the applicant proposes reduced rear yards of 10.4 percent on Lot 001, and 16.6 percent on both Lot 002 and Lot 003; and

 

WHEREAS, Section 3332.28, Side or rear yard obstruction, requires the area in the side or rear yard to be open from the finished grade to the sky, while the applicant proposes to maintain two stacked parking spaces that encroach into the western side yard of Lot 003; and

 

WHEREAS, the Southwest Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval because the request includes a high level of site and architectural design that is consistent with the Southwest Area Plan and C2P2 Design Guidelines and is compatible with the surrounding residential development; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for each proposed two-unit dwelling on Lot 001 and Lot 002, and a Certificate of Zoning Clearance for the retained single-unit dwelling on Lot 003; and

 

WHEREAS, said variances will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variances will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 1855 TANIS DR. (43123), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Sections 3332.02, R-rural district; 3332.06, R-rural area district requirements; 3332.21(B), Building lines; 3332.27, Rear yard; and 3332.28, Side or rear yard obstruction, of the Columbus City Codes; is hereby granted for the property located at 1855 TANIS DR. (43123), insofar as said sections prohibit a two-unit dwelling on Lot 001 and Lot 002 in the R, Rural District; with reduced lot area from five acres to 0.18 acres, 0.11 acres, and 0.18 acres for Lot 001, Lot 002, and Lot 003, respectively; reduced building lines from 25 to 21 feet along Tanis Drive for each proposed two-unit dwelling on Lot 001 and Lot 002; reduced rear yards from 25 percent to 10.4 percent on Lot 001, and to 16.6 percent on Lot 002 and Lot 003; and a western side yard obstruction for two stacked parking spaces on Lot 003; said property being more particularly described as follows:

 

1855 TANIS DR. (43123), being 0.49± acres on the south side of Tanis Drive, 440± feet west of Lazar Road, and being more particularly described as follows:

Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Virginia Military Survey Nos. 4641 and 6843 being part of an Original 0.585 acre tract (Parcel 9) being conveyed to JVR Property Solutions, LLC by deed of record in Instrument Number 202306210060591, all records herein are from the Recorder's Office Franklin County, Ohio, said 0.119 acre tract being more particularly described as follows:

 

BEGINNING FOR REFERENCE at a MAG Nail set at the centerline intersection of Tanis Drive (50' R/W) as shown and delineated in Plat Book 41, Page 63 and Lazar Road (50' R/W). as shown and delineated in Plat Book 31, Page 49;

 

Thence North 84°58'24" West, a distance of 592.80 feet, along the centerline of said Tanis Drive, to a point;

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a two-unit dwelling (Lot 001 and Lot 002) and a single-unit dwelling (Lot 003), in accordance with the submitted site plan, or those uses allowed in the R, Rural District.

 

SECTION 3.  That this ordinance is further conditioned on the subject site being developed in general conformance with the site plan titled, "SITE PLAN," dated September 8, 2025, and signed by Jonathan Romanovich, Applicant. The plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed.  Any slight adjustments to the plan shall be subject to review and approval by the Director of the Department Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4.  That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for each proposed two-unit dwelling on Lot 001 and Lot 002, and a Certificate of Zoning Clearance for the retained single-unit dwelling on Lot 003.

 

SECTION 5.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
