Explanation

 

This legislation authorizes the Director of Public Utilities to enter into an infrastructure maintenance agreement that sets forth maintenance responsibilities of the Columbus Downtown Development Corporation dba Downtown Columbus, Inc. (DCI)

 

The agreement concerns nonstandard improvements within the public rights-of-way of the City in association with the ROADWAY - Capital Line - Gay Street Phase 1 project, CIP No. 531089-100000. The limits of said improvements are between the rights-of-way lines along the following roadways: Gay Street from Front Street to Fourth Street (the “Premises”), as set forth within the City of Columbus, Department of Public Service, Plan Number 4085-E.

 

The installation of the nonstandard improvements by DCI on behalf of the City is conditioned upon the promise and obligation of DCI to undertake the maintenance responsibilities of the nonstandard improvements. These will include street, pedestrian, and decorative lighting, trench drains, catch basins, and drainage pipes.

This legislation is being put forth as an emergency measure in order to maintain the current project completion schedule.

 

 

Title

 

To authorize the Director of Public Utilities to enter into an infrastructure maintenance agreement with Downtown Columbus, Incorporated for nonstandard improvements within public right-of-way; and to declare an emergency. ($0.00)

 

 

Body

 

WHEREAS, the City desires to enter into an infrastructure maintenance agreement with DCI for nonstandard improvements within the public right-of-way; and

 

WHEREAS, the limits of the improvements will be between the rights-of-way lines along the following roadways: Gay Street from Front Street to Fourth Street; and

 

WHEREAS, said improvements will include street, pedestrian, and decorative lighting, trench drains, catch basins, and drainage pipes; and

 

WHEREAS, the installation of the nonstandard improvements by DCI is conditioned upon the promise and obligation of DCI to undertake the maintenance responsibilities of the nonstandard improvements, and prior to installing the improvements, infrastructure maintenance agreements with DCI are needed; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to enter into an infrastructure maintenance agreement with Downtown Columbus, Inc. for nonstandard improvements within public right-of-way, without delay, for the immediate preservation of the public health, peace, property and safety; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Public Utilities is hereby authorized to enter into an infrastructure maintenance agreement with Downtown Columbus, Inc. related to the Capital Line Phase 1 - Gay St. Project.

 

SECTION 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
