Explanation
 
The Public Service Department, Transportation Division, recently received a request from NTK Hotel Group, LLC, asking that the City grant an encroachment easement into Wall Street for the installation of an underground grease interceptor at the Hampton Inn and Suites at the northwest corner of North High and Spruce Street.  After investigation it has been determined that the granting of the requested encroachment easements will not adversely affect the City's continued use of the Wall Street right-of-way and that the requested encroachment easement should be granted.  A value of $500.00 was established for the granting of this encroachment easement.
 
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the granting of the requested encroachment easement.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from NTK Hotel Group, LLC, asking that the City grant an encroachment easement into Wall Street for the installation of an underground grease interceptor at the Hampton Inn and Suites at the northwest corner of North High and Spruce Street; and
 
WHEREAS, after investigation it has been determined that the granting of the requested encroachment easement will not adversely affect the City's continued use of the Wall Street right-of-way; and
 
WHEREAS, a value of $500.00 has been established for the granting of the requested encroachment easement; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Public Service Director be and is hereby authorized to execute those documents necessary to grant the following described encroachment easement to NTK Hotel Group, LLC; to-wit:
 
Situated in the City of Columbus, Franklin County, Ohio, being an easement in the right-of-way of Wall Street for a grease interceptor for a building located on Lots numbered 120 and 121 as conveyed to Elsie Y. Oppenheimer by deed of record in Official Records Volume 3204, page 502 with referenced to lots, streets, and alleys as numbered and shown on the L. Goodales Exrs. Subdivision in Plat Book 2, page 65, with all references as found in the Recorder's Office, Franklin County, Ohio and being more particularly described as follows:
Beginning for reference at the southeasterly corner of said Lot 117, said point being the intersection of the west right-of-way line of North High Street and the north right-of-way line of Spruce Street;
Thence North 88°08'26" West, along the north right-of-way line of Spruce Street and the south line of said Lot 117, a distance of 144.54 feet to a point in the southwest corner of said Lot 117 and also being in the east line of a 16.0 foot alley;
Thence North 01°51'34" East, along the west line of said Lots 117, 118, 119 and 120 and the east line of said 16.0 foot alley, a distance of 90.83 feet to the TRUE POINT OF BEGINNING of the herein described easement;
Thence North 88°08'26" West, perpendicular to the previous course, a distance of 4.50 feet to a point;
Thence North 01°51'34" East, a distance of 9.00 feet to a point;
Thence South 88°08'26' East, a distance of 4.50 feet to a point in the east line of said 16.0 foot alley and the west line of said Lot 120;
Thence South 01°51'34" West, along the east line of said 16.0 foot alley and the wet line of said Lot 120, a distance of 9.00 feet to the point of beginning;
Containing 40.50 square feet of right-of-way, more or less;
Bearings are based on the eat right-of-way line of High Street being North 10°07'00" West as shown on the Boundary Plat for the Convention Center of Columbus

Section 2.  That the $500.00 to be received by the City as consideration for the granting of the requested encroachment easement shall be deposited in Fund 748, Project 537650.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
