Explanation
1. BACKGROUND
The City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the Universal Road Reconstruction project. The purpose of this project is to reconstruct Universal Road between Fairwood Avenue and Progress Avenue. Improvements within the project limits include full depth pavement replacement, new curb and gutter, 5-foot wide sidewalks on both sides of Universal Road and improvement of the radii at the Universal Road and Fairwood Avenue intersection. The construction plans for this project are complete and approved through the signature process; it is now time to begin right-of-way acquisition.
Preliminary acquisition costs for title work, appraisal and other administrative expenses are estimated to be $90,000.00. It is anticipated additional funds will be requested after receipt of the property appraisals and the start of negotiations with the property owners. It is now necessary to authorize the City Attorney's Real Estate Division to begin right-of-way acquisition and to expend $90,000.00 for the costs associated with the acquisition of the rights-of-way needed for the Universal Road Reconstruction project.
2. Fiscal Impact
Monies to pay for these costs are available due cancellation of encumbrances from completed projects.
3. Emergency Justification
This reconstruction project is currently scheduled to begin in 2010. To maintain this schedule right-of-way acquisition must begin immediately; therefore, emergency action is requested.

To authorize the City Attorney's Office, Real Estate Division, to begin acquisition of the rights-of-way needed for the Universal Road Reconstruction project; to authorize the expenditure of $90,000.00 or so much thereof as may be necessary to allow for the acquisition of these rights-of-way from the Streets and Highways G.O. Bonds Fund; and to declare an emergency. ($90,000.00)

WHEREAS, the purpose of this project is to reconstruct Universal Road between Fairwood Avenue and Progress Avenue; and
WHEREAS, improvements within the project limits include full depth pavement replacement, new curb and gutter, 5-foot wide sidewalks on both sides of Universal Road and improvement of the radii at the Universal Road and Fairwood Avenue intersection; and
WHEREAS, construction plans for this project are complete and approved through the signature process; it is now time to begin right-of-way acquisition; and
WHEREAS, preliminary acquisition costs for title work, appraisal and other administrative expenses are estimated to be $90,000.00; and
WHEREAS, it is now necessary to authorize the City Attorney's Real Estate Division to begin right-of-way acquisition and to expend $90,000.00 for the costs associated with the acquisition of the rights-of-way needed for the Universal Road Reconstruction project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that this reconstruction project is currently scheduled to begin in 2010 which requires the City Attorney's Office, Real Estate Division, be immediately authorized to begin acquisition related activities and to expend $90,000.00 for such activities for the preservation of the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Attorney's Office, Real Estate Division, be and is hereby authorized to acquire those rights-of-way needed for the Universal Road Reconstruction Project.
Section 2. That the 2009 CIB authorized within ordinance 0806-2009 be amended due to the cancellation of AC029747, currently in process, as follows:

Section 5. That the City Attorney's Office, Real Estate Division, be and is hereby authorized to expend $90,000.00, or so much thereof as may be necessary from the Streets and Highways G.O. Bonds Fund as follows: Project 530161; Department-Division 59-12; Minor Object 6601; OCA Code 590046; to pay those costs relative to the acquisition of rights-of-way needed for the Universal Road Reconstruction Project.
Section 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
