Title: To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release certain sanitary sewer easements, at the request of the Wexner Heritage Village, in exchange for a replacement easement previously granted to the City of Columbus, Ohio.
Explanation
 
Background:    The City of Columbus, Ohio is the holder of certain sanitary sewer easements located in the vicinity of College Avenue and Livingston Ave.  The Wexner Heritage Village has requested the City release certain portions of the aforementioned sanitary sewer easements in exchange for previously granted replacement easements.  After investigation, it has been determined that the proposed exchange of easements will not adversely affect the City and therefore should be granted.  The following legislation authorizes the Director of the Department of Public Utilities to execute those instruments necessary to release the aforementioned sanitary sewer easement at no charge.

Title
 
To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release certain sanitary sewer easements, at the request of the Wexner Heritage Village, in exchange for a replacement easement previously granted to the City of Columbus, Ohio.
 
Body
WHEREAS,      the City of Columbus, Department of Public Utilities, is the owner of certain sanitary sewer easements located in the vicinity of College Avenue and Livingston Avenue, more fully described in the body of this ordinance; and
 
WHEREAS,      the Wexner Heritage Village, has requested that certain portions the aforementioned sanitary sewer easements be released, at no charge in exchange for a replacement easement previously granted to the City of Columbus; and
 
WHEREAS,      the Division of Sewerage & Drainage, after investigation, has determined that the release of a portion of the aforementioned easement rights will not adversely affect the operations of the City of Columbus and should be allowed; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Director of the Department of Public Utilities be, and hereby is, authorized to execute those documents prepared by the Department of Law, Real Estate Division, necessary to release certain portions of sanitary sewer easements in and to the following described real property, to wit:

      Situated on the State of Ohio, County of Franklin, City of Columbus, being part of a 3.568 acre tract conveyed to the Jewish Community Senior Citizens Housing Corp., by deed of record in Deed Book 3588, Page 567, Recorder's Office, Franklin County, Ohio, and being more particularly described as follows:
      Commencing at a found iron pipe at a corner common to said 3.568 Acre tract with an original 8.50 Acre tract conveyed to Columbus Jewish Welfare Foundation (Deed Book 2095, Page 55, said Recorder's Office);
      Thence, North 49 degrees 49 minutes 24 seconds East, 30.88 feet to the center of an existing manhole, the TRUE POINT OF BEGINNING OF THIS DESCRIPTION;
      Thence, across said 3.568 Acre tract the following two (2) courses:
 
1)      North 13 degrees 44 degrees 24 seconds West, 5.22 feet to a point;
 
2)      South 86 degrees 57 minutes 22 seconds East, 64.56 feet to the intersection of said line with a south line 3.568 Acre tract (north line of said 8.50 Acre tract);
Thence, along a common line of said 3.568 Acre and 8.50 Acre tracts, South 76 degrees
03 minutes 03 seconds West, 34.22 feet to a point;
Thence across said 3.568 Acre tract the following two (2) courses:
1)      North 86 degrees 57 minutes 22 seconds West, 28.82 feet to a point;
2)      North 13 degrees 44 minutes 24 seconds West, 5.22 feet to the place of beginning CONTAINING 0.011 ACRES (467 Square Feet).  Bearings are based on the Ohio State Plane Coordinate System, NAD, 83, South Zone.

Situated in the State of Ohio, County of Franklin, City of Columbus, being part of an original 8.50 acre tract conveyed to Columbus Jewish Welfare Foundation by deed of record in Deed Book 2095, Page 55, Recorder's Office, Franklin County, Ohio and being more particularly described as follows:
      Commencing at a found Franklin County Monument at the intersection of the north line of Berwick (as same is delineated on the recorded plat thereof, of record in Plat Book 19, Page 25, said Recorder's Office), with the east line of Half Section 34;
      Thence, along the north line of said Berwick, North 86 degrees 53 minutes 25 seconds West, 756.55 feet to a point;
      Thence, North 03 degrees 06 minutes 35 seconds East, 31.58 feet to the center of an existing manhole, the TRUE POINT OF BEGINNING OF THIS DESCRIPTION;
      Thence, across said 8.50 acre tract, and along part of the south line of said easement, North 86 degrees 57 minutes 22 seconds West, 97.84 feet to the intersection of said line with a north line of said 8.50 acre tract and a south line of the Jewish Community Senior Citizens Housing Corp. 3.568 acre tract (Deed Book 3588, Page 567, said Recorder's Office);
      Thence, along part of the said north line of the 8.50 acre tract (part of said south line of the 3.56 Acre tract), North 76 degrees 03 minutes 03 seconds East, 34.22 feet to the intersection of said line with the north line of said existing 10 foot easement;
      Thence, across said 8.50-acre tract and along part of the north line of said easement, South 86 degrees 57 minutes 22 seconds East, 68.78 feet to an angle point in said line;
      Thence, continuing along said line, South 80 degrees 26 minutes 19 seconds East, 2.89 feet to a point;
      Thence, across said 8.50 acre tract and said easement, South 37 degrees 05 minutes 14 seconds West, 5.64 feet tot eh place of beginning CONTAINING 0.019 ACRES (848 Square Feet).  Bearings are based on the Ohio State Plane Coordinate System, NAD 83, South Zone.
 
 
      Section 2.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
